Title
Authorizing the appropriation and expenditure in an amount not to exceed $59,190 from the Sewer Replacement Fund to pay Industrial Power Systems (IPS) for emergency repairs to the Detwiler Storm Pump Station in North Toledo; waiving the formal competitive procurement process under TMC Section 187.20; making certain findings with respect thereto; and declaring an emergency.

SUMMARY & BACKGROUND:
The Detwiler Storm Pump Station serves the Detwiler Park Golf Course. The station building was damaged by a tree downed by the tornado event on June 15, 2023. Despite the damage the station remained operational. Steps were taken to shore up the structure so final repairs could be made, but the building continued to deteriorate making the pumps non-functional. On July 31, 2023, after an informal bidding process, IPS was authorized to repair the building and return the pumping system to operational status.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the appropriation of $59,190 from the unappropriated balance of the Sewer Replacement Fund to Account Code 6073-36000-4UC5923STDSTD for emergency repairs to the Detwiler Storm Pump Station is authorized; and the expenditure of the same is authorized.
SECTION 2. That the mayor is authorized to award an emergency contract to and pay IPS for emergency repairs to the Detwiler Storm Pump Station, upon terms and conditions approved by the Director of Public Utilities and the Director of Law.
SECTION 3. That Council finds and determines that, pursuant to TMC Chapter 187.20, it was in the best interest of the City to waive formal competitive bidding for the reason that the repairs were an emergency that could not have been reasonably foreseen and would have resulted in an interruption or detriment to utility services and the repair cost has been deemed reasonable by the Director of Public Utilities.
SECTION 4. That the Finance Director is authorized to issue their warrant or warrants against the Account Code identified in Section 1 in an amount not to exceed $59,190 in payment of the obligations authorized above upon presentation of the proper voucher or vouchers.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to pay IPS for emergency repairs to the Detwiler Storm Pump Station in North Toledo.
