Title
Authorizing the Mayor to enter into an Agreement with the Lucas County Commissioners and the Lucas County Solid Waste Management District (LCSWMD) to commit all of the City’s recyclables from the City-wide Curbside Recycling Program to LCSWMD; and to enter into favorable terms to process those recyclables; and declaring an emergency.

SUMMARY & BACKGROUND:
The City’s current rate to process recyclables is cost prohibitive. Since there is not a Materials Recovery Facility (MRF) or cost effective transfer facility in our area, all the recyclables have to be shipped a considerable distance, which adds to the cost of processing. A local MRF will reduce cost by eliminating the need for transportation, as well as allowing for control of how and where the processed recyclables are marketed.
A MRF or transfer facility is only economically feasible if there is a volume of recyclables dedicated to it. The City of Toledo, by dedicating all of the recyclables collected through the Curbside Recycling Program, will make it feasible for Lucas County to build a MRF or hybrid-MRF as contemplated in the District’s Solid Waste Management Plan. City Council adopted Resolution 102-14 supporting the City of Toledo committing all recyclables collected from the Curbside Recycling Program to Lucas County if a MRF is built. The City will not have to pay for the building of the MRF or hybrid-MRF and will negotiate rates and terms for the processing of the materials.
Additionally, Lucas County intends to purchase equipment for the compaction of recyclables prior to transportation. This equipment will provide significant cost savings to the City in the time before a MRF can be constructed. The County intends to make application for a ----grant from Ohio EPA to support this purchase.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to execute a 20-year Agreement with the LCSWMD upon the rates and terms as approved by the Mayor, Director of Public Service, and the Director of Law.
SECTION 2. That the expenditures, as required to meet the City’s obligations under the Agreement authorized in Section 1, are authorized from the General Fund Account Code 1001-24500-6232002STDSTD and/or from the Solid Waste Trust Fund Account Code 2090-24500-6T23201STDSTD as a continuing obligation subject to future appropriations.
SECTION 3. That the Mayor is authorized to accept any revenues generated from the sale of the recyclable material per the Agreement and to deposit said revenues into the General Fund Account Code 1001-24500-6232002STDSTD and/or into the Solid Waste Trust Fund Account Code 2090-24500-6T23201STDSTD.
SECTION 4. That the Director of Finance is authorized to draw his warrant or warrants against the above referenced account codes in payment of the above authorized obligations upon presentation of proper voucher or vouchers.
SECTION 5. That the City of Toledo supports LCSWMD in its grant application to Ohio EPA for compaction equipment and urges Ohio EPA to assist in this project.
SECTION 6. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that the Ordinance must be immediately effective in order for the City of Toledo’s recyclable materials to be processed.
