SUMMARY & BACKGROUND:

The Board of the Downtown Toledo Improvement District has requested the City include certain City-owned properties as part of its proposed amended and restated Articles of Incorporation, Services Plan, Budget.  The four City-owned properties are 435 N. St. Clair Street; 243 N. Huron Street; 706 Madison Avenue; and 120 Water Street.  The total estimated assessment, which includes 1% fee by the County, is $6,921.74 per year for 5 years.  It is found and determined that the inclusion of these properties within the District and the assessment of these properties is in the best interests of the revised District and the City.

 

The fiscal impact of this ordinance is as follows:

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.  That the mayor is authorized to execute and deliver a petition for the inclusion of the following three identified City of Toledo properties within the Revised Downtown Toledo Improvement District (“District”) at the estimated yearly total assessment as indicated:

 

 

 

                     SECTION 2.  That, subject to available appropriations in future years, an annual expenditure of an amount not to exceed $6,921.74 is authorized as from the General Fund, Account Code 1001-16400-5000436STDSTD, in payment of the assessments listed in Section 1.

 

                     SECTION 3.  That the Director of Finance is authorized to draw his warrant or warrants against the above-listed Account Code upon presentation of the proper voucher or vouchers.                     

 

                     SECTION 4.  That this Council accepts and confirms inclusion of the properties listed in Section 1 in the District, which pursuant to Chapter 1702 and Chapter 1710 of the Revised Code to be governed by the Corporation and that this Council finds and determines that the inclusion of the properties are conducive to the public health, convenience and welfare of the City and its inhabitants and the properties of the City so identified are specially benefited by the inclusion within the District and the assessment. 

 

                     SECTION 5.  That this Council finds and determines that all formal actions of this Council and any of its Committees concerning and relating to the adoption of this Ordinance were taken, and all deliberations of this Council or any of its committees which resulted in such formal actions were held in meetings open to the public, and in compliance with all legal requirements including those of Section 121.22 of the Revised Code.

 

                     SECTION 6.  That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its adoption.  The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety and property; and for further reason that immediate action is necessary in order to protect the environment of the City, as well as provide and enable the timely levying, certification and collection of the special assessment for the provision of the services and benefits identified in the District Plan.
