Title

Authorizing the expenditure of $15,000 from the Risk Management Fund for the representation of a former city employee by the Spengler Nathanson law firm related to litigation pending in the Lucas County Court of Common Pleas; and declaring an emergency.

SUMMARY & BACKGROUND:

 

As the result of a potential conflict of interest, the Spengler Nathanson law firm was retained to represent a former city employee as part of the lawsuit captioned Harris v. City of Toledo, Lucas County Court of Common Pleas Case No. CI 2024-2349.  As the legal expenses have exceeded $10,000, additional monies are required to pay legal fees for outside counsel.

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

SECTION 1.  That the Mayor and Director of Law are authorized to enter any necessary agreements with the law firm of Spengler Nathanson to provide legal services in the litigation captioned Harris v. City of Toledo regarding representation of a former city employee.

 

SECTION 2.  That $15,000 is appropriated from the unappropriated balance of the Risk Management Fund to Account Code 7095-12000-537400-1157001STDSTD.

 

SECTION 3. That the Director of Finance is authorized to draw their warrant or warrants against the Account Code 7095-12000-537400-1157001STDSTD and to expend an amount not to exceed $15,000 in payment of the obligations authorized in Section 1 upon presentation of proper voucher or vouchers. 

 

                     SECTION 4.  That this ordinance, being an emergency measure, shall take effect and be in force from and after its passage.  The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of public peace, health, safety and property and for further reason that this ordinance must immediately be effective so the City may effectively and timely pursue the above referenced litigation and promptly pay obligations incurred for the delivery of legal services.
