Title

Submitting to the Toledo City Plan Commission a request for a review of proposed text amendments to Toledo Municipal Code Chapter 1104 by enacting Section 1104.2800 “Detention Facility” and Section 1104.2801 “Special Use Permit Required”; authorizing a public hearing on said text amendments and publication of said hearing; and declaring an emergency.

 

Summary

SUMMARY & BACKGROUND:

 

WHEREAS, the City of Toledo desires to promote policies that advance public safety, inclusion, accountability, and public trust; and

 

WHEREAS, in response to increased federal immigration enforcement efforts, this proposed text amendment is part of a package of policies that are intended to provide clarity to both its employees and the public as to the City’s involvement with immigration enforcement efforts; and

 

WHEREAS, the City does not operate any services for the purpose of federal immigration laws and enforcement of civil immigration is under the sole authority of the federal government; and

 

WHEREAS, Toledo is home to thousands of immigrants, refugees, and their families who all make this city their home and in light of recent immigration enforcement efforts, Council feels an obligation to enact policies that demonstrate our support and protection for those residents; and

 

WHEREAS, detention facilities have unique operational characteristics, health and safety considerations, and require a unique set of public services. This makes them distinct in their land use and oversight needs. Thus, in order to determine the suitability of proposed facilities for a select location a special use permit should be required;

 

NOW THEREFORE, Be it resolved by the Council of the City of Toledo:

 

                     SECTION 1: That the Toledo City Plan Commission review zoning regulations and detention centers as contained in Toledo Municipal Code Chapter 1104 “Use Regulations” by enacting Section 1104.2800 “Detention Facility” and Section 1104.2801 “Special Use Permit Required”.

 

SECTION 2: That the request for proposed text amendments is hereby referred to the Toledo City Plan Commission for its review, recommendation and appropriate hearing date. The Attachment of Exhibit A includes text amendments submitted by Council for review. That a public hearing upon a proposed ordinance to effectuate the above-described change shall be held in the Council Chambers at One Government Center and the Clerk of Council is hereby authorized and directed to give notice of the time and place of said hearing in the manner required by law.

 

SECTION 3: That this Resolution hereby is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property, and that this Resolution must be immediately effective so that the text amendments can be expeditiously forwarded to Toledo City Plan Commission in order to provide clarity and protection for our employees and residents of City of Toledo.
