SUMMARY & BACKGROUND:

The Division of Transportation has been working closely with ODOT to secure grant dollars through a Congestion Mitigation and Air Quality (CMAQ) funding opportunity. The grant dollars awarded to the City require a 20% match. $640,000 maximum has been allocated by ODOT through CMAQ funds. Therefore, the City’s match on the total $800,000 project is $160,000. The engineer’s estimate is $701,000.

 

Passage of this Ordinance is required to enable the City of Toledo to accept outside funding for these projects and have it in place to help pay for these expenditures.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1. That the Mayor is authorized to enter into and execute cooperative agreements with and to accept financial assistance from the State of Ohio Department of Transportation (ODOT) for LUC SR (Lucas County State Route) 51 (Monroe Street) Corridor Improvements upon such terms and conditions shall be approved by the Director of Public Service and the Director of Law.

 

SECTION 2. That the Mayor is authorized to accept and deposit grant proceeds from ODOT into the Capital Improvements Fund in an amount not to exceed $640,000 for the following project:

 

 

SECTION 3. That the sum of $640,000 is appropriated from the unappropriated grant proceeds of the Capital Improvement Fund into the Account Code listed in Section 2 for the project listed above; and the expenditure of same is authorized for said project.

 

SECTION 4. That the Mayor is authorized to prepare plans and specifications and to accept bids and enter into contracts in an amount not to exceed $800,000 for the project listed above including, but not limited to, such items as labor, materials, construction testing, professional services, property appraisals, title work, negotiations, acquisition, and environmental contamination studies that are necessary to acquire additional rights-of-way. Contracts shall contain such terms and conditions as the Mayor may deem requisite and proper and shall be subject to approval by the Director of Public Service and the Director of Law.

 

SECTION 5. That the Finance Director is authorized to issue his warrant or warrants against the Account Code identified in Section 2 in an amount not to exceed $800,000 in payment of the obligations incurred pursuant to the contracts authorized in Section 4 upon presentation of the proper voucher or vouchers.

 

                     SECTION 6. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to facilitate the planning and construction of this project.
