SUMMARY & BACKGROUND:

In order for the expansion/remodeling of the Federal Court House project to proceed, it is necessary that the driveway entrance of the Toledo Municipal Court building off of Spielbusch, leading to the tunnel and underground parking structure, be closed and removed. This Ordinance further authorizes the expenditure of $200,000 to cover the costs of the closure and removal.

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.  That the mayor is authorized to enter into an agreement with The Whiting-Turner Contracting Company for the purpose of demolishing and closing the City-controlled tunnel/ramp leading into the underground parking structure of the Toledo Municipal Court building upon such terms and conditions as approved by the Director of Public Service and the Director of Law.

 

SECTION 2. That this City Council finds and determines that it is in the best interest of the City to waive the competitive procurement requirements of Chapter 187 of the Toledo Municipal Code for reason that the project scope was competitively bid by the U. S. General Services Administration.

 

SECTION 3. That the expenditure in an amount not to exceed $200,000 is authorized from Capital Improvement Fund Account Code 5040-26100-8CP2115CCMTUN for demolition and closure of the tunnel/ramp leading into the underground parking structure of the Toledo Municipal Court building.

 

SECTION 4. That the Director of Finance is authorized to issue warrant or warrants against the account code listed in Section 3 in an amount not to exceed $200,000 in payment of the above authorized obligations upon presentation of the proper voucher or vouchers.

 

SECTION 5.  That the mayor and other appropriate City officers are authorized to execute such agreements, documents or instruments, including needed intergovernmental agreements, and take such other actions, as deemed necessary by the Director of Law.

 

SECTION 6.  That this Ordinance is declared to be an emergency measure and shall be in force and take effect from and after its passage.  The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property and to adhere to the federal courthouse construction schedule.
