SUMMARY & BACKGROUND:
The Toledo Municipal Code Part Thirteen - Building Code, Chapter 1311.08 Renewal of Certificates, specifies the renewal procedure for contractor and construction trade registration. This ordinance allows the renewal of certificates (licenses) to extend to the end of the year. The Boards of Control have agreed to the proposed change.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the existing Toledo Municipal Code 1311.08, which reads as follows;
1311.08. Renewal of certificates.
(a) Expiration. Certificates issued in accordance with this chapter shall expire at 12:00 p.m., local time, on December 31, but may be renewed for the next succeeding year period by the payment of the annual renewal fee on or before close of business, January 31, of the next succeeding year.
(b) Renewal after expiration. If a person holding a valid certificate of qualification under the provisions of this chapter in any year fails to renew such license before the annual renewal fee is due, as provided for in subsection (a) hereof, shall be considered a new applicant and must pay the original registration fee. Note: See Section 1311.04( b) (3) D. for renewal after expiration requirements for electrical journeyman.
(c) Application for Renewal. Application for certificate renewal shall be made on a form furnished by the Building Official for this purpose.

SECTION 2. That a new Toledo Municipal Code 1311.08 Renewal of Certificates, which reads as follows:
1311.08. Renewal of certificates. (a.k.a. licenses)
(a) Expiration; Certificates issued in accordance with this chapter shall expire at midnight on December 31st. Certificates may be renewed with no penalty up until January 31st of the succeeding year. Certificates after January 31st up until December 31st may be renewed with an added penalty of $50.00. Certificates shall not be renewed after 12 months from the original expiration. No work shall be performed with an expired certificate.
(b) Expiration over 12 months; Any person who fails to renew their certificate of qualification as provided in subsection (a) of this chapter hereof, shall be considered a new applicant and must pay the original registration fee along with passage of the appropriate exam. Note: See Section 1311.05 (b)(3)D. for renewal after expiration requirements for electrical journeyman.
(c) Application for Renewal; Application for certificate renewal shall be made on a form furnished by the Division of Building Inspection for this purpose.

SECTION 3. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this legislation is needed to correct and reconcile provisions of the code.
