Amending Toledo Municipal Code Section 1106.0401 “Review” by repealing the prior version and enacting a new amended version thereof; and declaring an emergency.

SUMMARY & BACKGROUND:

This ordinance amends the Toledo Municipal Code (“TMC”) to allow multi-dwelling density bonuses to be granted via administrative site plan review.  The change will allow more compact development/redevelopment in the downtown and midtown regions to approved without unnecessary barriers. This change is consistent with the City’s Forward Toledo Comprehensive Land Use Plan and stated purpose of the Zoning Code.

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That Toledo Municipal Code §1106.0401 which states as follows:

 

§1106.0401 Review.

Any reduction under this section must be applied for and reviewed under the Major Site Plan review provisions of Section 1111.0800, unless the development is subject to Special Use review or an Institutional Master Plan, in which case review of a proposed reduction under this section shall be conducted under that procedure.

 

Is repealed.

 

SECTION 2.  That Toledo Municipal Code §1106.0401 is enacted to state as follows:

 

§1106.0401 Review.

Any reduction under this Section must be applied for and reviewed under the Site Plan review provisions of Sec. 1111.0800, unless the development is subject to Special Use review or an Institutional Master Plan, in which case review of a proposed reduction under this section shall be conducted under that procedure.

 

                      SECTION 3.  That this Ordinance hereby is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property, and that this Ordinance must be immediately effective in order to provide accurate and complete standards for use by property owners.

 

Vote on emergency clause:  yeas 10 nays 0.

 

Adopted:  March 3, 2026, as an emergency measure:  yeas 10, nays 0.
