Title
Authorizing the Mayor to accept bids and enter into one (1) year contract(s), with the option for up to two (2) one-year renewals, for the purpose of providing sanitary sewer and water service disconnections, abandonments, and related plugging at the public sewer and water mains (“abandonments”) for City of Toledo and private demolition projects; authorizing annual expenditures in amounts not to exceed $336,298 from the Water Operating Fund and $608,702 from the Sewer Operating Fund, subject to appropriation; and declaring an emergency.

SUMMARY & BACKGROUND:
In accordance with Toledo Municipal Code (TMC) Chapter 927, Section 927.13, and Part Nine, Title Three, Appendix C, Section 100.07, when a building is demolished or when a sewer or water service is otherwise taken out of service, the applicable connection to the public sewer or water system must be properly disconnected, abandoned, plugged, or “abandoned” at the tapping or opening into the public sewer or water main. The Division of Sewer and Drainage Services requires competitively procured unit-based contract(s) to perform these sanitary sewer and water service abandonments for City of Toledo projects and private demolition projects. Contractors shall be selected through a competitive bidding or procurement process consistent with Toledo Municipal Code Chapter 187 and all other applicable laws, ordinances, rules, and regulations.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to accept bids and enter into one (1) year contract(s), with the option for up to two (2) one-year renewals, for sanitary sewer and water service disconnections, abandonments, plugging, and related work commonly referred to as sewer and water “abandonments,” for the City of Toledo and private demolition projects, upon such terms and conditions as approved by the Director of Public Utilities and the Director of Law.
SECTION 2. That, subject to appropriation, the annual expenditure of an amount not to exceed $336,298 is authorized from the Water Operating Fund, Account Code 6060-37000-4000512WTRKIL, for City water abandonments; the annual expenditure of an amount not to exceed $289,852 is authorized from the Sewer Operating Fund, Account Code 6070-37000-4000558STDSTD, for City sewer abandonments; and the annual expenditure of an amount not to exceed $318,850 is authorized from the Sewer Operating Fund, Account Code 6070-37000-4651006SWRKIL, for private sewer abandonments.
SECTION 3. That the Finance Director is authorized to issue warrant or warrants against the above-referenced account codes in amounts not to exceed those authorized herein in payment of the obligations authorized above upon presentation of the proper voucher or vouchers.
SECTION 4. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety, and property, and for the further reason that immediate effectiveness is necessary to allow the City to timely procure and maintain contract services for sanitary sewer and water abandonments required in connection with City of Toledo and private demolition projects.
