SUMMARY & BACKGROUND:

The Division of Engineering and Construction Management has been working closely with ODOT to secure grant funding for a Safe Routes to School project.  Ord. 680-23 previously authorized the acceptance of $396,694 for this grant.  An additional $89,271 has been allocated by ODOT for the Safe Routes to School project through an amendment, for a maximum grant amount of $486,965.  This funding will be added to the Safe Routes to School project grant that was previously awarded and accepted. Matching funds for this project will be provided through the Division of Engineering and Construction Management Matches and Planning program.  The project is scheduled for construction in 2025.

 

Passage of this ordinance is required to enable the City of Toledo to accept this additional outside funding for this project and have it in place to help pay for these expenditures. 

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

SECTION 1.                       That the Mayor is authorized to enter into and execute an amended cooperative agreement with and accept financial assistance from the State of Ohio Department of Transportation (ODOT) for the 2025 Safe Routes to School project upon such terms and conditions as shall be approved by the Director of Transportation and the Director of Law.

 

SECTION 2.                     That the Mayor is authorized to accept and deposit additional grant proceeds from ODOT in an amount not to exceed $89,271 into the Capital Improvement Fund Account Code 540G-35000-8GA7163STDSTD for the 2025 Safe Routes to School project.

 

SECTION 3.  That an amount not to exceed $89,271 is appropriated from the grant proceeds of the Capital Improvement Fund into Account Code 540G-35000-8GA7163STDSTD for the project listed above; and authorizing expenditure of same.

 

SECTION 4.   That the Mayor is authorized to prepare plans and specifications and to accept bids and enter into contracts for said project including such items as labor, materials, construction testing, professional services, property appraisals, title work, negotiations, acquisition, and environmental contamination studies that are necessary to acquire additional rights-of-way. Contracts shall contain such terms and conditions as the Mayor may deem requisite and proper and shall be subject to approval by the Director of Transportation and the Director of Law.

 

SECTION 5.  That the Finance Director is authorized to issue their warrant or warrants against the Account Code identified in Section 2 in an amount not to exceed $89,271 in payment of the obligations incurred pursuant to the contracts authorized in Section 4 upon presentation of the proper voucher or vouchers.

 

                     SECTION 6.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to facilitate the planning and construction of this project.
