SUMMARY & BACKGROUND:

An application (Z25-0027) for a proposed change in zoning from “IG” General Industrial to “CR” Regional Commercial for the property located at 5820 and 5930 Hagman Road, in Toledo, Ohio, was submitted to the Toledo City Plan Commission for its review and recommendation.

 

On November 6, 2025, the Toledo City Plan Commission recommended approval of the request for a zone change from “IG” General Industrial to “CR” Regional Commercial for the property located at 5820 and 5930 Hagman Road, in Toledo, Ohio.

 

On December 10, 2025, the Toledo City Council Zoning and Planning Committee referred as approved the request for a zone change from “IG” General Industrial to “CR” Regional Commercial for the property located at 5820 and 5930 Hagman Road, in Toledo, Ohio.

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

SECTION 1.  That the zoning maps attached to Part 11, Planning and Zoning, Toledo Municipal Code, are hereby authorized to be revised by changing the zoning district of that part of the City of Toledo more fully described as follows:

 

PARCEL 1

Being a part of the West½, of the Southwest¼, of the Southwest¼, of Section 5, Township 9 South, Range 8 East, in the City of Toledo, County of Lucas, State of Ohio, also being part of land as conveyed to Marathon Petroleum Company by deeds recorded as Deed 81-158-EO7; Deed 81-158-EO9; Deed in Volume 1935, Page 626; and Deed 88-391-EOS of the Lucas County, Ohio Recorder's Office, and being more particularly described as follows:

Commencing at the intersection point for the centerline of Alexis Road (also being the South line of said Section 5) and the centerline of Hagman Road (also being the West line of said Section 5);

Then on and along said centerline for Hagman Road (West line of Section 5) a bearing ofN01th 00° 00' 00" East, a distance of 224.08 feet to the "True Point of Beginning" for the land herein described;

Thence departing said centerline of Hagman Road, North 90° 00' 00" East, 25.00 feet to a point;

The next five (5) courses being along the limited access right-of-way as conveyed to the State of Ohio by deeds recorded in Volume 2002d, Page 913 and Volume 1990d, Page 548 of the Lucas County, Ohio Recorder's Office;

Thence South 09° 27' 28" East, a distance of 60.86 feet to a point;

Thence South 00° 00' 00" West, a distance of 48.40 feet to a point;

Thence South 35° 01' 49" East, a distance of 31.53 feet to a point;

Thence South 89° 48' 53" East, a distance of 54 7.49 feet to a point;

Thence South 83 ° 01' 19" East, a distance of 161.84 feet to a point;

Thence departing said limited access right-of-way line a bearing of North 00° 00' 00" East, a distance of 619.32 feet to a point;

Thence North 89° 49' 42" West, a distance of 761.23 feet to a point in the centerline of Hagman Road (also being the West line of said Section 5);

Thence on and along said centerline and West section line, a bearing of South 00° 00' 00" West, a distance of 465.92 feet to the point of beginning.

Containing 10.4158 acres more or less.

Being a part of the West½, of the Southwest¼, of the Southwest¼, of Section 5, Township 9 South, Range 8 East, in the City of Toledo, County of Lucas, State of Oluo, also being part of land as conveyed to Marathon Petroleum Company by deeds recorded as Deed 81-158-EO7; Deed 81-158-EO9; Deed in Volume 1935, page 626; .and Deed 88-391-EO9 of the Lucas County, Ohio Recorder's Office, and being more particularly described as follows:

Commencing at the intersection point for the centerline of Alexis Road (also being the South line of said Section 5) and the centerline of Hagman Road (also being the West line of said Section 5);

Then on and along said centerline for Hagman Road (West line of Section 5) a bearing of North 00° 00' 00" East, a distance of 690.00 feet to the "True Point of Beginning" for the land herein described;

Thence departing said centerline of Hagman Road, South 89° 49' 42" East, a distance of 761.23 feet to a point;

Thence South 00° 00' 00" West, a distance of 619.32 feet to a point in the North limited access right-of-way line of Alexis Road;

The next three (3) courses being along the said limited access right-of-way as conveyed to the State of Ohio by deeds recorded in Volume 2002d, Page 913, ai1d Volume 1990d, Page 548, of the Lucas Com1ty, Ohio Recorder's Office;

Thence South 77° 19' 17" East, a distance of I 75.33 feet to a point;

Thence South 68° 29' 03" East, a distance of 90.51 feet to a point in the South line of said Section 5;

Thence on and along the South line of said Section 5, a bearing of South 89° 48' 53" East, a distance of 311.15 feet to a point in the East line of the West ½, of the Southwest ¼, of the Southwest ¼, of said Section 5;

Thence on and along the said East line, a bearing of North 00° 19' 58" East, a distai1ce of 982.19 feet to a point;

Thence North 89° 48' 53" West on and along a line being the North line of the South 30 acres of the West½, of the Southwest¼, of the Southwest¼, of said Section 5, a distance of 1333.35 feet to a point in the West line of said Section 5;

Thence on and along the West line of said Section 5 (also being the centerline of Hagmai1 Road), a bearing of South 00° 00' 00" West, a distance of292.14 feet to the point of beginning.

Containing 17.7048 acres more or less.

Said premises being more currently described in combination by survey prepared by Lewai1dowski Engineers under date of February 23, 2001 as follows:

Being Part of the Southwest Quarter of the Southwest Quarter of Fractional Section 5, Town 9 South, Range 8 East, in the City of Toledo, Lucas County, Ohio, bounded ai1d described as follows:

Commencing at a monument found at the Southwest comer of Fractional Section 5, said monument being at the intersection of the centerlines of Alexis Road, so called, ai1d Hagman Road, so called.

Thence North 00 degrees, 00 minutes, 00 seconds West, along the West line of Fractional Section 5 and the centerline of Hagman Road, a distance of 224.08 feet to the true point of beginning.

Thence continuing North 00 degrees, 00 minutes, 00 seconds West along the West line of Fractional Section 5 ai1d the centerline of Hagman Road, a distance of 764.92 feet to a point on a line of agreement as recorded in Deed Volume 93-0514-All of Lucas County records.

Thence South 89 degrees, 49 minutes, 42 seconds East, along said line of agreement, and passing a ½" galvanized steel pipe set at 25.00 feet, a distance of 1333.41 feet to a point on the West right-of-way of a parcel of land as conveyed to the former Detroit-Toledo Shoreline Railway by Deed Volume 1931, Page 141-151, Lucas County records, and now vested in the name of the Canadian National Railway. From said point an iron bar is found 0.11 feet North and 0.02 feet East.

Thence South 00 degrees, 20 minutes, 04 seconds West, along the West right-of-way of the Canadian National Railway, a distance of 989 .31 feet to a point on the limited access right-of-way of Alexis Road and the South line of Fractional Section 5. From said point an iron bar is found 0.05 feet East.

Thence North 89 degrees, 48 minutes, 53 seconds West, along the limited access right-of-way of Alexis Road and the South line of Fractional Section 5, a distance of 311.13 feet to a point. From said point an iron bar is found 0.27 feet west and 0.08 feet South.

Thence North 68 degrees, 29 minutes, 03 seconds West, along the limited access right-of-way of Alexis Road, a distance of90.53 feet to a point. From said point an iron bar is found 0.23 feet West and 0.12 feet South.

Thence North 77 degrees, 19 minutes, 17 seconds West, along the limited access right-of-way of Alexis Road, a distance of 175.33 feet to a point. From said point an iron bar is found 0.07 feet West and 0.09 feet South.

Thence North 83 degrees, 01 minutes, 19 seconds West, along the limited access right-of-way of Alexis Road, a distance of 161.84 feet to a point. From said point an iron bar is found 0.21 feet East and 0.02 feet North.

Thence North 89 degrees, 48 minutes, 53 seconds West, along the limited access right-of-way of Alexis Road, a distance of 54 7.49 feet to a point.

Thence North 35 degrees, 01 minutes, 49 seconds West, along the limited access 1ight-of-way of Alexis Road, a distance of 31.53 feet to a point on the East right-of-way of Hagman Road.

Thence North 00 degrees, 00 minutes, 00 seconds East, along the East right-of-way of Hagman Road, a distance of 48.40 feet to a drilled hole set.

Thence North 09 degrees, 27 minutes, 28 seconds West along the East 1ight-of-way of Hagman Road, a distance of 60.86 feet to a drilled hole set.

Thence South 90 degrees, 00 minutes, 00 seconds West, a distance of25.00 feet to the true point of beginning.

Containil1g 1,234,220.10 square feet, or 28.334 acres of land, of which 19,122.06 square feet or 0.439 acres of land are withi11 the public road right-of-way of Hagman Road. Subject to all easements of record or now i11 use.

All bearings are based upon an assumed meridian and are for the express purpose of showing angular measurement. All ½" galvanized steel pipe set are marked with a cap bearing the company name and P.S. number 7476. The above description is based on field survey performed by Matthew D. Lewandowski, P.S on February 24, 2001.

 

SECTION 2.  The Secretary of the Toledo City Plan Commission is hereby authorized and directed to make the said change on the original zoning maps.

 

SECTION 3.  That this Ordinance hereby is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that the Ordinance must be immediately effective in order to provide for the orderly regulation and use of the property and to protect the land value in the area.
