Title
Authorizing the Mayor to enter into a contract for the installation of Courtesy Benches throughout the City and trash and recycling receptacles in the downtown area; and declaring an emergency.

SUMMARY & BACKGROUND:
The City currently has a permit system for the provision of Courtesy Benches at bus stop locations throughout the City. The Toledo Municipal Code requires that trash cans be affixed and maintained at each location and that benches be maintained in good condition. It has been determined that the vast majority of bench locations are not in compliance with these requirements, and many of the benches are in a state of disrepair. Additionally, City crews have been maintaining these sites, putting a strain on limited City resources. As such, none of the current benches are properly permitted. In an effort to update these locations and improve the aesthetics and usability of these locations, the City issued a Request for Proposals for the provision of updated and uniform benches and trash receptacles throughout the City and trash and recycling receptacles in the downtown area. A Request for Proposals was issued on March 22, 2019. Three proposals were received, and it is recommended that a contract be awarded to FUEL Martin Outdoor, LLC as the best overall proposal.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to execute a contract with FUEL Martin Outdoor, LLC for the installation of Courtesy Benches and trash receptacles at bus stop locations throughout the City and for the installation of trash and recycling receptacles in the downtown area along with maintenance and service to those locations. Said contract shall contain such terms and conditions as the Mayor may deem requisite and proper and shall be subject to approval by the Director of Law.
SECTION 2. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective in order to expeditiously upgrade the existing Courtesy Bench locations.
