SUMMARY & BACKGROUND:

The Division of Road and Bridge Maintenance in cooperation with Toledo Metroparks is constructing a multi-use path across the MLK Bridge. Ordinance 577-23 authorized acceptance of a grant for $1,483,659 from Metroparks and a grant for $4,237,615 from ODOT. Ordinance 162-24 authorized acceptance of an additional grant for $1,622,107 from ODOT. Ordinance 345-24 authorized acceptance of an additional grant for $500,000 from a Congressional Earmark for the MLK Bridge project.  Ordinance 94-24 authorized expenditure of matching funds through the Division of Road and Bridge Maintenance Matches and Planning fund.  An additional $896,148 has been awarded by ODOT through the Local Major Bridge Program.  This ordinance authorizes the Mayor to accept and expend these funds.

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

SECTION 1.                     That the Mayor is authorized to enter into an amended agreement with and to accept and deposit additional proceeds from ODOT in an amount not to exceed $896,148 for the construction of the multi-use path across the MLK Bridge Project upon such terms and conditions as approved by the Director of Transportation and the Director of Law.

                     

SECTION 2. That the appropriation of an amount not to exceed $896,148 is authorized from the unappropriated grant proceeds in the Capital Improvement Fund to Account Code 540G-23100-8GA8643STDSTD; and the expenditure of the same is authorized for the purpose in Section 1.

 

SECTION 3.  That the Mayor is authorized to accept bids and award contracts for the construction of the multi-use path over MLK Bridge project. Contracts shall contain such terms and conditions as the Mayor may deem requisite and proper and shall be subject to approval by the Director of Transportation and the Director of Law.

 

                     SECTION 4.  That the Finance Director is authorized to draw their warrant or warrants against the above Account Code in an amount not to exceed $896,148 in payment of the obligations authorized above upon presentation of the proper voucher or vouchers.

 

SECTION 5. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective in order to meet project deadlines for the construction of a multi-use path across the MLK Bridge Project.
