SUMMARY & BACKGROUND:
This legislation authorizes funding for a pilot tree sidewalk repair program to mitigate tree root related damage and prepare for a successful 2026 Sidewalk Program. The goal of the program is to conserve and protect mature street trees while improving damaged sidewalks, accessibility, and safety. This program encourages collaboration by engineers and arborists early in the process of sidewalk improvements and construction adjacent to street trees. Authorized expenses include contract work for the labor and materials to furnish the following sidewalk rehabilitation approaches:
• Shave/ slice
• Re-route sidewalk: remove sidewalk material, create bulb-out, and or meander
• Replace w/ Flexipave or Addapave product
• Complete sidewalk replacement w/ shaving tree roots
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the appropriation of $65,000 is authorized from the unappropriated balance of the Capital Improvement Fund to Account Code 5040-27100-8CP2521SIDWLK and the expenditure of same is authorized for sidewalk improvements as part of the tree sidewalk rehabilitation pilot project.
SECTION 2. That the Mayor is authorized to accept bids and award contracts for the purposes specified in Section 1 upon terms and conditions as acceptable to the Director of Law and the Director of Public Service.
SECTION 3. That the Finance Director is authorized to draw their warrant or warrants against the above Account Code in payment of the above authorized obligations in amounts not to exceed $65,000 upon presentation of the proper voucher or vouchers.
SECTION 4. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property and for the further reason that this Ordinance must be immediately effective in order to preserve critical tree infrastructure in City of Toledo, improve safety and accessibility of sidewalks in City right-of-way, and plan and implement a successful Sidewalk Program.
