SUMMARY & BACKGROUND:
The Division of Engineering and Construction Management is requesting authority to expend an amount not to exceed $1,750,000 from the Capital Improvement Fund for the construction of a bike path on the Anthony Wayne Trail from South Avenue to Glendale Avenue. The bike trail will be a separate bike path along the Anthony Wayne Trail that will help complete the Riverside Bike Trail as adopted in the City of Toledo Bike Plan.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the expenditure of an amount not to exceed $1,750,000 is authorized from the Capital Improvement Fund Account Code 5040-35000-8CB2220RIVSID for the Riverside Bike Trail along the Anthony Wayne Trail.
SECTION 2. That the Mayor is authorized to prepare plans and specifications, accept bids and enter into contracts to complete said project including such items as labor, materials, construction testing, and professional services for property appraisals, title work, negotiations, acquisition, and environmental contamination studies that are necessary to acquire additional rights-of-way. Contracts shall contain such terms and conditions as the Director of Transportation may deem requisite and proper and shall be subject to approval by the Department of Law.
SECTION 3. That the Finance Director is authorized to issue their warrant or warrants against the account code identified in Section 1 above in an amount not to exceed $1,750,000 in payment of the above-authorized obligations upon presentation of the proper voucher or vouchers.
SECTION 4. That the disappropriation of any remaining budget to fund balance is authorized at project closeout.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective in order to facilitate this work being bid, awarded, and constructed before the end of the current construction season.
