Title
Authorizing the Mayor to execute a supplement to the construction contract with Vernon Nagel, Inc; authorizing the appropriation and the expenditure in an amount not to exceed $20,000 to pay the cost of separating sewer lines in Anthony Wayne Trail Gateway Project; and declaring an emergency.

SUMMARY & BACKGROUND:
Ordinances 512-16 and 234-17 authorized the Mayor to apply for, enter into an agreement and accept a loan from the Ohio Water Development Authority (OWDA) for an amount not to exceed $879,930 for the Toledo Waterways Initiative (TWI) portion of the Anthony Wayne Trail Gateway (AWT) Project. Due to multiple delays and sewer modifications caused by unforeseen utility conflicts, the cost for sewer separation has exceeded the loan. To complete the remaining sewer separation portion of the project, an additional $20,000 from the unappropriated balance of the Sanitary Sewer Replacement Fund is needed. The unappropriated balance of the Sanitary Sewer Replacement Fund is $29 Million. (Part of SCN Sewer Separation).
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to execute a supplement to the construction contract with Vernon Nagel, Inc. upon such terms and conditions shall be approved by the Director of Public Utilities and the Director of Law.
SECTION 2. That an amount not to exceed $20,000 is appropriated from the unappropriated balance of the Sanitary Sewer Replacement Fund, Account Code 6073-35000-4XC0318STDSTD for such items as labor and materials, miscellaneous project expenses and any repairs identified within 5 years of the project completion; and further authorizing the expenditure of same for the Anthony Wayne Gateway Project.
SECTION 3. That the Finance Director is authorized to issue his warrant or warrants against the Account Code listed above in Section 2 in amounts not to exceed $20,000 in payment of the above authorized obligations upon presentation of the proper voucher or vouchers.
SECTION 4. That the disappropriation of any remaining budget to fund balance at project closeout is authorized.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to permit timely completion of the Anthony Wayne Trail Gateway sewer separation portion of the Anthony Wayne Trail Gateway Project in accordance with the Consent Decree.
