Amending Ordinance 427-23; and declaring an emergency.

SUMMARY & BACKGROUND:
This Ordinance repeals Section 2 and Section 3 of Ordinance 427-23 and replaces it with new Section 2 and Section 3. Ordinance 427-23 authorized the Mayor to enter into five-year contract with Smart Energy Systems, Inc. dba Smart Energy Water (SEW) for the purpose of implementing of and subscription to a new utility customer portal. This ordinance amends the appropriation of funds to allow for the additional annual fees for add-ons indicated in the contract for the sake of customer accessibility.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That Section 2 and Section 3 of Ordinance 427-23 that reads as follows:
SECTION 2. That the appropriation and expenditure in an amount not to exceed $100,000 is authorized from the Water Replacement Fund, Account Code 6063-31000-4UC5323STDSTD and the appropriation and expenditure in an amount not to exceed $90,000 is authorized from the Sewer Replacement Fund, Account Code 6073-31000-4UC5323STDSTD, for the new utility customer portal.
SECTION 3. That, subject to appropriation, the annual expenditure of funds for the yearly subscription payment is authorized in an amount not to exceed $125,000 over the term of the contract.

That the appropriation and expenditure in an amount not to exceed $115,000 is authorized from the Water Replacement Fund, Account Code 6063-31000-4UC5323STDSTD and the appropriation and expenditure in an amount not to exceed $105,000 is authorized from the Sewer Replacement Fund, Account Code 6073-31000-4UC5323STDSTD, for the new utility customer portal.
SECTION 3. That, subject to appropriation, the annual expenditure of funds for the yearly subscription payment is authorized in an amount not to exceed $265,000 over the term of the contract.
SECTION 3. That this Ordinance is declared to be an emergency measure and shall take effect and be in force immediately from and after its passage. The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety and property and for the further reason that this ordinance must be immediately effective in order to ensure customer accessibility.
