SUMMARY & BACKGROUND:

This Ordinance authorizes the expenditure of $40,000 from the Sewer Replacement Fund and $45,000 from the Capital Improvement Fund for the purchase of vehicles for the Division of Engineering and Construction Management. The Division intends to trade-in existing vehicles toward purchases when possible. Funding has been approved for these vehicles in the 2023 budget.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.  That the expenditure of an amount not to exceed $40,000 is authorized from the Sewer Replacement Fund Account Code 6073-35000-4UC3423STDSTD for the purchase of a vehicle.

 

                     SECTION 2.                      That the expenditure of an amount not to exceed $45,000 is authorized from the Capital Improvement Fund Account Code 5040-35000-8C35000PROSUP for the purchase of a vehicle.

 

                     SECTION 3.  That the Mayor is authorized to accept bids and award contracts and/or enter into agreements using cooperative purchasing or state term contracts for the purchase of vehicles specified in Sections 1 and 2, upon terms and conditions acceptable to the Director of Transportation and the Director of Law.

 

                     SECTION 4.  That this Council finds and determines that it is in the best interest of the City to waive the competitive procurement requirements of Toledo Municipal Code Chapter 187 for the purchase of the subject vehicles considering limited availability in the prevailing equipment supply-chain market and where the Director of Transportation further finds and determines that the subject vehicles are not available utilizing competitive procurement and the cost thereof is deemed competitive and reasonable.

                       

                     SECTION 5.  That the Director of Finance is authorized to issue their warrant or warrants against the account codes listed above in an amount not to exceed $85,000 in payment of the above authorized obligations upon presentation of the proper voucher or vouchers.

 

SECTION 6.  That the disappropriation of any remaining budget to fund balance is authorized at project closeout.

 

SECTION 7. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to maintain safe, reliable vehicles for the Division of Engineering and Construction Management.
