SUMMARY & BACKGROUND:

It is the intent of this Ordinance to appropriate $88,044 from the Sewer Replacement Fund for the Division of Water Reclamation Belt Press Rental. The Water Reclamation Plant (Plant) has six (6) belt filter presses. Three belt filter presses were in the process of being rehabilitated when two of the remaining presses failed. An emergency action was taken to rent a temporary press to allow the plant to continue processing sludge and prevent failure of the plant treatment process. This work is necessary to maintain safe, reliable solids processing to maintain compliance with the NPDES discharge permit requirements, as set forth by the Ohio EPA.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.                     That the appropriation of $88,044 is authorized from the Sewer Replacement Fund to Account Code 6073-36000-4UC0922STDSTD and expenditure of same is authorized the for the rental services necessary to facilitate the Belt Filter Press Rental Project at the Water Reclamation Plant.

 

SECTION 2.                     That the Mayor is authorized to enter into a contract with Merrell Bros., Inc. for equipment rental services necessary to facilitate the completion of the Belt Filter Press Rental project at the Water Reclamation Plant, subject to approvals by the Director of Public Utilities and the Director of Law.

 

SECTION 3.  That Council finds and determines that, pursuant to TMC Chapter 187.20, competitive bidding was waived for the reason that it was an emergency that could not have been reasonably foreseen and would result in an interruption or detriment to utility services and the rental cost has been deemed reasonable by the Director of Public Utilities.

 

SECTION 4. That the Director of Finance is authorized to issue her warrant or warrants against the account code listed in Section 1 in an amount not to exceed $88,044 in payment of the above authorized obligations upon presentation of the proper voucher or vouchers.

 

                     SECTION 5. That the Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to maintain the operational integrity of the Water Reclamation Plant, and to maintain compliance with the NPDES discharge permit requirements, as set forth by the Ohio EPA.
