Title

Enacting Chapter 1768 of the Toledo Municipal Code, Tenants’ Right to Counsel in Eviction Proceedings; authorizing the appropriation and expenditure of $250,000 from the unappropriated balance of the General Fund; authorizing the Mayor to enter into an agreement with Legal Aid of Western Ohio; and declaring an emergency.

Summary

WHEREAS, housing is a human right and the access to safe, secure and accessible housing is essential to achieving equal access to all other fundamental needs; and

WHEREAS, evictions create significant costs for state and local government related to shelter funding, education funding, health care provided in hospitals instead of community-based providers, transportation costs for homeless youth, and foster care; and

WHEREAS, studies have shown that many tenants have defenses to the eviction that they are not able to assert (either at all of successfully) without assistance of counsel; and

WHEREAS, evictions have significant, well-documented, and long-lasting effects on the lives of individuals and families, including poorer physical and mental health, increased risk of homelessness, increased risk of employment loss, loss of personal property, damage to credit standing, and relocation into sub-standard housing; and

WHEREAS, evictions and the subsequent housing instability and displacement damage the lives of children by negatively impacting their mental and physical health, decreasing school attendance rates, impeding academic performance, increasing instances of school discipline, and increasing the likelihood of out of home placement; and

WHEREAS, providing a right to counsel to tenants in eviction cases is a proven means of preventing the disruptive displacement of families and the resulting social, economic and public health costs of such displacement; and

WHEREAS, Toledo City Council believes that interests in civil cases can be significant and there exists an inherent unfairness if a case goes forward with one side represented and the other side unrepresented; and

WHEREAS, evictions exacerbate the continuing public health crisis posed by COVID-19 by forcing many into close quarters with others in a “doubling up” scenario, or in crowded homeless shelters, and whereas evictions have been proven to increase COVID-19 infection and mortality rates; and

WHEREAS, it is the policy of the City of Toledo that tenants facing an eviction from the homes shall have a right to legal representation in eviction and related proceedings, and the City of Toledo shall provide for that representation to tenants to assist in the fair administration of justice; NOW, THEREFORE,

Be it ordained by the Council of the City of Toledo:

If the projected need for legal representation to Covered Individuals exceeds the available funds, the provision of legal services may be prioritized by reasonable standards as decided by the Designated Organization.

(d)                     The Designated Organization will promulgate such regulations as necessary to implement a legal representation program pursuant to this section and the funding limits for the program.

(f)                     On January 31 of each year, the Designated Organization will submit a written report to Toledo City Council detailing the number of covered individuals served, the extent of legal services performed, metrics evaluating outcomes, as well as a summary of the engagement and education of tenants.

(g)                     Legal Aid of Western Ohio, Inc. shall be named as the Designated Organization to assign itself and/or Advocates for Basic Legal Equality, Inc. to provide legal services to Covered Individuals, or to engage another organization or other entity to provide legal representation, engagement, and education.

(h)                     This law takes effect immediately upon receipt of funding from the City by Legal Aid of Western Ohio, Inc.
