Title

Authorizing the expenditure of $41,000 from the Water Operating Fund for the emergency repair of the watermain on Manhattan Blvd. at Nearing Ave.; authorizing the Mayor to enter into an amended contract with Crestline Paving for said repair; and declaring an emergency.

Body

SUMMARY & BACKGROUND:

Ordinance 488-22 authorized a contract with Crestline Paving for the emergency repair of the watermain on Manhattan Blvd. at Nearing Ave. Upon excavation, it was discovered the entire 30” valve needed replacement due to a leaking leaded joint. Additionally, other emergency-required repairs to the deteriorating watermain and valve discovered after the initial work began. This Ordinance authorizes the expenditure of $41,000 for this additional work at the same unit prices as the original quotes for the initial emergency repair, which is necessary to maintain a safe, reliable service that will meet the demands of the City of Toledo's water distribution system.

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

SECTION 1. That an expenditure not to exceed $41,000 is authorized from the Water Operating Fund Account Code 6060-34000-4000514STDSTD for the emergency replacement of the watermain on Manhattan Blvd. at Nearing Ave.

SECTION 2. That the Mayor is authorized to enter into an amended contract with Crestline Paving for the emergency replacement of the watermain on Manhattan Blvd. at Nearing Ave, upon terms and conditions acceptable to the Director of Public Utilities and the Director of Law.

SECTION 3.  That Council finds and determines that, pursuant to TMC Chapter 187.20, competitive bidding was waived for the reason that it was an emergency that could not have been reasonably foreseen and would result in an interruption or detriment to utility services and the repair cost has been deemed reasonable by the Director of Public Utilities and considering the contractor was originally selected through an informal expedited request for quotations.

SECTION 4. That the Director of Finance is authorized to issue their warrant or warrants against the account code listed in Section 1 in an amount not to exceed $41,000 in payment of the above authorized obligations upon presentation of the proper voucher or vouchers.

SECTION 5. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to permit the earliest possible construction of critical elements in the City of Toledo’s water distribution system.
