(“CWR”) in order to facilitate the continued processing of leaf composting material and creation of top soil; authorizing the expenditure of $147,000; waiving the competitive bidding provisions of TMC 187; and declaring an emergency.

SUMMARY & BACKGROUND:
Pursuant to Ordinance 151-18, a five (5)-year agreement was enacted with CWR for the purpose of site management at both Elmdale and Riverside composting facilities, the receipt and handling of leaf material and the creation of topsoil from that leaf material. The current agreement is dated to expire in June 2024, though the legislative authority is dated to expire in June 2023. This ordinance is to parallel the language in the current agreement with the appropriate legislative authority to expend the funds to satisfy the city’s contractual obligation through the terms of said agreement.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into a one (1)-year extension of the Agreement with CWR for the receipt and handling of leaf material, creation of topsoil and site management of both Elmdale and Riverside composting facilities upon such terms and conditions are met with the approval of the Mayor, Director of Public Service, and the Director of Law.
SECTION 2. That pursuant to the terms of the agreement established by Ord. 151-18, the sum of $147,000 is authorized for expenditure from Account Code 3050-27100-2421001STDSTD, as a continuing obligation of the City in payment for management of the composting sites to CWR for the life of this agreement.
SECTION 3. That the Director of Finance is authorized to draw his warrant or warrants against the Account Code listed above in an amount not to exceed $147,000 upon presentation of the proper voucher or vouchers.
SECTION 4. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property and for the further reason that this ordinance must be immediately effective to provide efficient leaf disposal, create topsoil for the City’s use, manage the City’s two compost facilities located at Elmdale and Riverside.
