SUMMARY & BACKGROUND:
The Bay View Water Reclamation Facility (Plant) includes two Gravity Thickening Tanks, GT1 and GT2, that are part of the Solids Handling Process. The Division of Water Reclamation (Division) desires to pay for emergency tank cleaning services, critical for plant operations and for compliance with Ohio EPA rules and regulations. The Division does not have the equipment and resources to remove wastewater sludge from the non-functioning tank or dewater and dispose of said sludge at accepted facilities. The Division requests permission to contact qualified and experienced contractors to handle emergency tank cleaning services. The Division would normally advertise for formal and informal bids when project completion is not critical for plant operations.
Summary
NOW THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the expenditure of $500,000 is authorized from the Sanitary Sewer Operating Fund from Account Code 6070-36000-4000507STDSTD for emergency tank cleaning and related services of Gravity Thickening Tank 2.
SECTION 2. That the Mayor is authorized to enter into contracts for emergency tank cleaning and related to services for emergency tank cleaning upon terms and conditions approved by the Director of Public Utilities and the Director of Law.
SECTION 3. That this Council finds and determines it is in the best interest of the City to waive the competitive bidding provisions of TMC Chapter 187 for emergency tank cleaning and related services to avoid disruption to plant operations and maintain compliance with Ohio EPA’s NPDES discharge permit at the Bay View Water Reclamation Facility.
SECTION 4. That the Finance Director is authorized to issue their warrant or warrants against the Account Code identified in Section 1 in an amount not to exceed $500,000 in payment of the authorized obligations upon presentation of the proper voucher or vouchers.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to facilitate emergency tank cleaning and related services for a situation that impacts plant operations and threatens compliance with Ohio EPA’s NPDES discharge permit at the Bay View Water Reclamation Facility.
