Authorizing the appropriation of $2,107 and the expenditure of $70,107 from the Sewer Replacement Fund and the appropriation of $1,925 and expenditure of $57,925 from the Storm Water replacement Fund and the expenditure of $46,000 from the Water Replacement Fund for the purchase and installation of airflow control upgrades for the fume hoods at Environmental Services; authorizing the Mayor to enter into contract for said purpose; waiving competitive bid provisions of TMC Chapter 187; and declaring an emergency.

SUMMARY & BACKGROUND:
It is the intent of this ordinance to expend $174,032 for the airflow control upgrades of six fume hoods at Environmental Services that have been in continuous service for twenty-eight (28) years. Replacement parts for the existing airflow control systems from Phoenix Controls are no longer available. This upgrade is critical and essential for the safety of lab personnel working with hazardous material to perform analyses that comply with the Ohio EPA National Pollutant Discharge Elimination System (NPDES) permit for stormwater, as well as federal, state and local regulations for the Pretreatment program. Critical Aire is the sole representatives for Phoenix Controls in Ohio. Funding was initially approved for this project in 2023 but due to cost increases and compliance with project labor agreements addition funding is needed.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the appropriation in an amount not to exceed $2,107 is authorized from the Sewer Replacement Fund into Account Code 6073-38000-4UC2923STDSTD, and the appropriation of $1,925 is authorized from the Stormwater Replacement Fund into Account Code 607D-38000-4UC2923STDSTD for the purchase and installation of airflow control upgrades of the fume hoods at Environmental Services.
SECTION 2. That the expenditure in an amount not to exceed $70,107 is authorized from Account Code 6073-38000-4UC2923STDSTD, an amount not to exceed $57,925 is authorized for expenditure from Account Code 607D-38000-4UC2923STDSTD, and an amount not to exceed $46,000 is authorized for expenditure from Account Code 6063-38000-4UC2923STDSTD for the purchase and installation of airflow control upgrades of the fume hoods at Environmental Services.
SECTION 3. That the Mayor is authorized to enter into contract with Critical Aire for expenditures authorized in Section 2, upon terms and conditions acceptable to the Director of Public Utilities and the Director of Law.
SECTION 4. That Council finds and determines it is in the best interest of the City to waive the competitive procurement provisions of TMC Chapter 187 for the reason that Critical Aire is the sole representative for Phoenix Controls in Ohio for the airflow control upgrades of the fume hoods necessary to maintain compatibility with existing equipment at Environmental Services.
SECTION 5. That the Finance Director is authorized to draw their warrant or warrants in amounts not to exceed those authorized above from the Account Codes listed in Section 2 for payment of the obligations incurred pursuant to the above-authorized agreements upon presentation of proper voucher or vouchers.
SECTION 6. That the disappropriation of any remaining budget to fund balance is authorized at project closeout.
SECTION 7. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property, and for further reason that the Ordinance must be immediately effective in order to allow for the critical and essential airflow control upgrade of the fume hoods at Environmental Services.
