Title

Approving the Lucas County Solid Waste Management District’s 2018 - 2032  Solid Waste Management Plan update pursuant to Ohio Revised Code Section 3734.55(B); and declaring an emergency.

SUMMARY & BACKGROUND:

The Lucas County Solid Waste Management District (the “District”) is established by Lucas County pursuant to Chapter 343 of the Ohio Revised Code (“ORC”) to effectuate the purposes of preparing, amending, adopting, submitting, and implementing a Solid Waste Management Plan (the “Plan”) pursuant to Sections 3734.52, et seq., of the ORC for the safe and sanitary management of solid wastes within all the incorporated and unincorporated territory of the District. The Plan is prepared in accordance with ORC Section 3734, the State of Ohio’s Solid Waste Management Plan and the Ohio Environmental Protection Agency’s (“OEPA”) guidelines.  The Plan also describes strategies and programs that will be implemented to meet or exceed the minimum state waste reduction goals and objectives. The District completed the draft amended Plan and submitted it to the OEPA for review and comment on November 21, 2016 and the OEPA provided comments in a non-binding advisory opinion on January 5, 2017.  The District’s Policy Committee has reviewed the non-binding advisory opinion received from the OEPA and taken these comments into consideration and incorporated changes into the amended Plan as appropriate. The District has conducted a 30-day comment period from September 28, 2017 to October 27, 2017 and a public hearing was held on October 31, 2017 to provide the public an opportunity to comment on the Plan.  The Policy Committee adopted the amended plan on November 2, 2017 and delivered it to the required legislative authorities for ratification.  The amended Plan identifies the District’s strategy for the management of solid wastes generated in Lucas County through the year 2032.   ORC 3734.55(B) requires the legislative authority of a municipality to approve or disapprove the District’s amendments to the Plan.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

                        

                     SECTION 1.                       That pursuant to Section 343.01 et. seq. and Section 3734.50 et. seq. of the Ohio Revised Code, and as the legislative authority, it hereby approves the Draft 2018- 2032 Solid Waste Management Plan as amended by the District, a copy of which is on file with the Clerk of Council.

 

                     SECTION 2.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that the Ordinance must be immediately effective in order for the Solid Waste Management Plan amendments to be implemented in a timely manner.
