Title

Authorizing the expenditure of $19,129 from the Water Operating Fund for emergency repair services to the natural gas pipe line that serves the Heatherdowns Pump Station; authorizing the Mayor to enter into an emergency contract with GEM Inc. Rudolph Libbe Group; waiving the competitive provisions of TMC Chapter 187; and declaring an emergency.

SUMMARY & BACKGROUND:

The Heatherdowns Pumping Station located at 2650 Cass Rd, Toledo Ohio boosts water pressure for South Toledo and communities to the southwest and houses other critical public utilities infrastructure. Recently the line that provides gas service to the heating system began leaking. As a safety precaution and in line with their health and safety protocols Columbia Gas Co. shut off their supply line to cut off gas flow to stop the leak and stated that it shall remain shut off until the Toledo owned section of line was repaired and passed a leak test. It was found that 110ft long 2-inch diameter natural gas service line needed to be replaced.  The work has been completed in April 2024 and the gas service has been restored. 

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.                     That the expenditure of $19,129 from the Water Operating Fund is authorized from Account Code 6060-32000-4000505STDSTD for emergency repairs at the Heather Downs Pumping Station.

 

SECTION 2.                     That the Mayor is authorized to enter into an emergency contract with GEM Inc. Rudolph Libbe Group for emergency repairs at the Heatherdowns Pumping Station, upon terms and conditions approved by the Director of Public Utilities and the Director of Law.

 

SECTION 3. That Council finds and determines that, pursuant to TMC Chapter 187.20, competitive bidding was waived for the reason that GEM Inc. Rudolph Libbe Group was immediately ready and proceeded with emergency repairs related to the gas line at the Heatherdowns Pump Station avoiding service interruption or detriment to the public service.

 

SECTION 4. That the Finance Director is authorized to issue their warrant or warrants against the Account Code identified in Section 1 in an amount not to exceed $19,129 in payment of the obligations authorized above upon presentation of the proper voucher or vouchers.

 

                     SECTION 5. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to pay GEM Inc. Rudolph Libbe Group for emergency repairs related to the gas line at the Heather Downs Pump Station.

 

Vote on emergency clause:  yeas 11, nays 0.
