SUMMARY & BACKGROUND:
The City of Toledo is the fee owner of certain properties located at 1101 Washington Street (Parcel No. 12-18707), 132 Indiana Avenue (Parcel No. 12-18714), 134 Indiana Avenue (Parcel No. 12-18721), and 128 Indiana Avenue (Parcel No. 12-18727), all situated within the City of Toledo, Lucas County, Ohio. In order to facilitate and ensure public access and connectivity to the proposed roundabout along Washington Street, it is necessary to dedicate portions of said properties as public right-of-way for transportation-related purposes, including, but not limited to, roadway infrastructure for safety and speed management.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the parcels of land described herein are dedicated for public right-of-way, including but not limited to roadway, utility and sewer purposes:
See EXHIBIT "A" legal description and EXHIBIT “B” drawing attached hereto and made a part hereof.
SECTION 2. That the parcels of land described in Section 1 is named and shall be hereafter identified as public right-of-way.
SECTION 3. That the Real Estate Division of the Department of Economic and Business Development is directed to cause a copy of this Ordinance to be recorded in the records of the Lucas County Recorder.
SECTION 4. That this Council approves the dedication of said real estate provided for herein notwithstanding.
SECTION 5. That it is found and determined that all formal actions of Council concerning and relating to the passage of this Ordinance were adopted in an open meeting of Council, and that all deliberations of Council and any of its committees that result in such formal action were in meetings open to the public in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.
SECTION 6. That this Ordinance is declared to be an emergency measure and shall take effect and be in force immediately from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property and for the further reason that this Ordinance must be immediately effective in order to effectuate the dedication of this right-of-way at the earliest possible date.
