SUMMARY & BACKGROUND:

Planning and design of the Bay View Water Reclamation Facility (BVWRF) Improvement Program is well underway which has identified a portion of Parcel Number 0238991, adjacent to the Reynolds Area Pump Station at 4150 Airport Highway that needs to be acquired in order to renovate or replace the pump station.  The Division of Engineering and Construction contracted with West Erie Realty Solutions, Inc. in 2025 to perform various real estate acquisition services as authorized by Ordinance 11-24.  This Ordinance authorizes the expenditure of appropriated loan funds for property acquisition, and authorizes supplementing West Erie’s contract for property acquisition services associated with the BVWRF Improvement Program.

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

SECTION 1. That the expenditure of an amount not to exceed $125,000 is authorized from Account Code 673L-36000-4UL0725STDSTD for the purchase of real property interests and property acquisition services for the acquisition of a portion of Parcel Number 0238991 for the Bay View Water Reclamation Facility Improvement Program.

 

SECTION 2. That the Mayor is authorized to amend the existing contract with West Erie Realty Solutions, Inc. in an amount not to exceed $15,000 for the provision of additional services associated with land acquisition for the Bay View Water Reclamation Facility Improvement Program, including but not limited to surveys, testing, title work, appraisals, closing costs, relocation costs, environmental assessments, and other incidental fees and expenses, upon terms and conditions deemed proper and requisite by the Director of Law. 

 

                     SECTION 3. That the Mayor is authorized to enter into a real estate purchase agreement and execute and deliver needed instruments for the acquisition of a portion of Parcel Number 0238991, upon terms and conditions acceptable to the Director of Public Utilities and the Director of Law.

 

SECTION 4.  That the Director of Finance is authorized to issue their warrant or warrants against the Account Code identified in Section 1 in amounts not to exceed $125,000 in payment of the above authorized obligations upon presentation of the proper voucher or vouchers.

 

                     SECTION 5.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to proceed with necessary improvements to the Water Reclamation facilities.
