Title

Authorizing the appropriation of $175,000 from the unappropriated balance of the Storm Water Replacement Fund and the expenditure of same for the Bandore Park Stream Restoration project; authorizing the Mayor to accept bids and enter into contracts for said project; and declaring an emergency.

SUMMARY & BACKGROUND:

The City of Toledo has been awarded funding from multiple agencies for the Bandore Park Stream Restoration Project; Environmental Protection Agency (EPA) for a Section 319(h) Grant in the amount of $299,610, Great Lakes Restoration Initiative $130,000, and H2Ohio $250,000. This Ordinance authorizes additional funding from the Storm Water Replacement Fund for this project. Construction is scheduled to begin later this year.

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1 That the appropriation of $175,000 is authorized from the unappropriated balance Storm Water Replacement Fund to Account Code 607D-38000-4UC3624STDSTD and the expenditure of same is authorized for the Bandore Park Stream Restoration project.

 

SECTION 2.                      That the Mayor is authorized to accept bids and execute contracts related to Bandore Park Stream Restoration project upon such terms and conditions as shall be approved by the Director of Public Utilities and the Director of Law.

 

SECTION 3.                      That the Director of Finance is authorized to issue their warrant or warrants against the Account Code above in an amount not to exceed $175,000 in payment of the obligations incurred pursuant to the above-authorized contracts upon presentation of proper voucher or vouchers.  

 

SECTION 4.                      That this Ordinance is declared to be an emergency and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property of the city and for the further reason that this ordinance must be immediately effective in order to implement this program within the Ohio Environmental Protection Agency’s designated time schedule.
