SUMMARY & BACKGROUND:
The Division of Water Reclamation (Division) contracted with Arcadis to perform Program Management of the Water Reclamation Facility Improvement Program under Ordinance 96-25. One of the improvements, Improvement 76, is a high priority project of the Program and is ready to move to final design.
The Facility Plan Program includes provisions for roughly 15% of design projects to be completed by design services outside of the Program Management Team to help assure that firms outside of this core have opportunities to participate in the program improvements. Improvement 76 was identified as one of the 15% projects. Proposals were solicited and Ribway Engineering Group was selected for these design services.
This ordinance will authorize entering into a loan agreement with the Ohio Environmental Protection Agency (Ohio EPA) Water Pollution Control Loan Fund and Ohio Water Development Authority and appropriating loan proceeds in an amount of $1,020,00 to cover design services. Authorization for the expenditure of this project was already passed under Ordinance 388-26.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to accept a loan from the Ohio EPA Water Pollution Control Loan Fund and the Ohio Water Development Authority and to deposit loan proceeds in an amount not to exceed $1,020,000 into the Sanitary Sewer Replacement Loan Fund, Account Code 673L-36000-4UL3426STDSTD, and to enter into necessary agreements for Improvement 76.
SECTION 2. That the dedicated source of repayment for said loan shall be the unappropriated balance of the Sanitary Sewer Replacement Fund provided, however, that any loan for this project shall be subordinate to all of the City’s sanitary sewer revenue bonds.
SECTION 3. That an amount not to exceed $1,020,000 is appropriated from the unappropriated loan proceeds in the Sanitary Sewer Replacement Fund into Account Code 673L-36000-4UL3426STDSTD for Improvement 76.
SECTION 4. That the Mayor is authorized to advertise for and accept bids and proposals for professional engineering services necessary to facilitate the design of Improvement 76 at the Water Reclamation Plant, subject to approvals by the Director of Public Utilities and the Director of Law.
SECTION 5. That the disappropriation of any remaining budget to fund balance is authorized at project closeout.
SECTION 6. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to maintain the operational integrity of the Water Reclamation Facility, and to maintain compliance with the National Pollutant Discharge Elimination System discharge permit requirements, as set forth by the Ohio Environmental Protection Agency.
