SUMMARY & BACKGROUND:
Petitioner has filed a request to vacate the 16-foot wide alley lying between Lots 348 and 313 in Port Lawrence Division, located in the city of Toledo, Lucas County, Ohio.
NOW THEREFORE, Be it resolved that:
SECTION 1. That the City Council does hereby declare its intent to vacate the 16-foot-wide alley lying between Lots 348 and 313 in Port Lawrence Division, located in the city of Toledo, Lucas County, Ohio, further described below:
Commencing at the most Westerly corner of said Lot Number 313, also being the southeasterly line of an Alley Way being 16.00 feet wide within the Plat of the Port Lawrence Division, said corner also being the Point of Beginning for this description.
1) Thence on the Northwesterly prolongation of the northeasterly right of way of Monroe Street for a distance of 16.00 feet to the most southerly corner of Lot Number 348;
2) Thence Northeasterly on the southeasterly lot line of said Lot Number 348, also being the northwesterly right of way of a 16.00 feet wide Alley way for a distance of 120 feet more or less to the most easterly corner of said Lot Number 348;
3) Thence Southeasterly for a distance of 16.00 feet as measured true from said southeasterly lot line of Lot Number 348 to a point of intersection being the southeasterly right of way of a 16.00 feet wide Alley way and the projected most northerly corner of Lot Number 313;
4) Thence Southwesterly on said southeasterly right of way of a 16.00 feet wide alley also being on the prolongated of the northwesterly lot line of said Lot Number 313 to the point of beginning.
Said parcel containing an Area of 1,920.00 Sq Ft or 0.0441 Acre of Land.
SECTION 2. That this matter be referred to the Toledo City Plan Commission for its review, recommendation and appropriate hearing date.
SECTION 3. That this Resolution hereby is declared to be an emergency measure and shall be in force and effect from and after its adoption. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Resolution must be immediately effective so that the vacation can be expeditiously completed to enable property owners to obtain the resulting benefits at the earliest time.
