Authorizing the Mayor to enter into cooperative grant agreements with and accept financial assistance from the State of Ohio Department of Transportation (ODOT) for roadway design and construction projects; authorizing the acceptance, deposit, appropriation, and expenditure of grant proceeds into the Capital Improvement Fund in an amount not to exceed $6,500,519; authorizing the Mayor to accept bids and award contracts related to the roadway design and construction; and declaring an emergency.

SUMMARY & BACKGROUND:
The Division of Engineering and Construction Management has been working closely with ODOT to secure grant funding for safety projects. All amounts are grant dollars and are assigned to specific projects as follows:
A maximum of $1,604,800 has been allocated by ODOT through the TMACOG TIP for a resurfacing and restriping project: Byrne Road from Heatherdowns to South Detroit. Matching funds will be provided through the Ohio Public Works Commission (OPWC) and the Division of Engineering and Construction Management Matches and Planning budget.
A maximum of $2,637,565 has been allocated by ODOT through the TMACOG TIP for a reconstruction project: Secor Road from Laskey to Alexis. Matching funds will be provided through the Ohio Public Works Commission (OPWC) and the Division of Engineering and Construction Management Matches and Planning budget.
A maximum of $665,000 has been allocated by ODOT through the TMACOG TIP for a reconstruction and bike path project: Water Street from the Martin Luther King Bridge to Olive Street. Matching funds will be provided through the Ohio Public Works Commission (OPWC) and the Division of Engineering and Construction Management Matches and Planning budget.
A maximum of $396,694 has been allocated by ODOT through their safety program for a sidewalk and striping project: Safe Routes to School at various locations throughout the Washington Local school district. Matching funds will be provided through the Division of Engineering and Construction Management Matches and Planning budget if necessary.
A maximum of $1,196,460 has been allocated by ODOT through their safety program for a sidewalk and crossing project: Systemic Safety at various locations throughout the City. Matching funds will be provided through the Division of Engineering and Construction Management Matches and Planning budget.
Passage of this ordinance is required to enable the City of Toledo to accept outside funding for these projects and have it in place to help pay for these expenditures.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into cooperative agreements with and accept financial assistance from the State of Ohio Department of Transportation (ODOT) for various projects upon such terms and conditions as shall be approved by the Director of Transportation and the Director of Law.
SECTION 2. That the Mayor is authorized to accept and deposit grant proceeds from ODOT into the Capital Improvement Fund in an amount not to exceed $6,500,519 for the following projects:

SECTION 3. That the sum of $6,500,519 is appropriated from the grant proceeds of the Capital Improvement Fund into the account codes listed in Section 2 for the projects listed above; and authorizing the expenditure of same.
SECTION 4. That the Mayor is authorized to prepare plans and specifications and to enter into contracts after accepting bids in an amount not to exceed $6,500,519 for the projects including such items as labor, materials, construction testing, professional services, property appraisals, title work, negotiations, acquisition, and environmental contamination studies that are necessary to acquire additional rights-of-way. Contracts shall contain such terms and conditions as the Mayor may deem requisite and proper and shall be subject to approval by the Director of Transportation and the Director of Law.
SECTION 5. That the Finance Director is authorized to issue their warrant or warrants against the account codes identified in Section 2 in an amount not to exceed $6,500,519 in payment of the obligations incurred pursuant to the contracts authorized in Section 4 upon presentation of the proper voucher or vouchers.
SECTION 6. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety, and property, and for the further reason that this Ordinance must be immediately effective in order to facilitate the planning and construction of these projects.
