Title
Authorizing the Mayor to enter into a three (3) year Lease, with three (3) optional three (3) year renewal periods as well as other provisions, between the City of Toledo and the Chester J. Zablocki Senior Citizens, Inc. (“Center”) located at 3015 Lagrange Street Toledo, Ohio 43608; and declaring an emergency.

SUMMARY & BACKGROUND:
In January 2006, the City of Toledo entered into a 3 year lease with Center (“Original Lease”). The Original Lease had 3 renewal periods each for 3 years, which is now expired. This legislation authorizes the Mayor to enter into a new lease for an initial term of 3 years with three renewals of 3 years each at an annual rent of $500. Operating expenses, including maintenance, taxes and insurance are to be paid by Center, except that any maintenance expense greater than $1,000 will be paid by City. All utilities, except telecommunications (i.e. internet, phone, cable, etc.) will be paid by City. No assignments or sublease rentals will be permitted without the prior written consent of City.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor and the Real Estate Division of the Department of Economic Development be and they are hereby authorized and directed to execute the Lease Agreement between the City of Toledo and Chester J. Zablocki Senior Citizens, Inc., for a term of three (3) years and an additional three (3) renewal terms of three (3) years.
SECTION 2. That the Lease shall contain an annual rent of $500 excluding operating expenses for any insurance premiums, maintenance expenses, and utilities as required by the Lease.
SECTION 3. That the Lease “Premises” are legally described in the Lease to include:
A part of Lots 173 through 176; all of Lots 150 through 156; the East 14.00 feet of Lot 157 together with a vacated 16.00 foot alley adjoining the East 14.00 feet of Lot 157, also the vacated 16.00 foot alley lying North of the East 5.00 feet of Lot 152, Lot 153 and the West 16.00 feet of Lot 154, also the entire vacated alley lying South of Lot 156 and the East 14.00 feet of Lot 157, also all of Lots 158 through 161 excepting therefrom that part of a newly dedicated alley as described in Ordinance No. 568-76 dated August 3, 1976 all in the Plat of Lagrange Street Addition in the City of Toledo, Lucas County, Ohio.
Including the non-exclusive use of immediately adjacent Lessor-owned common area parking, but excluding approximately 2,600 square feet of indoor space being leased by The Coalition for Quality Education.
SECTION 4. That the Lease shall contain other terms and conditions deemed necessary and proper by the Mayor, the Department of Law and the Department of Finance and Business Development.
SECTION 5. That the Lease Premises is not needed by the City for any municipal purpose and is in the best interest of the City.
SECTION 6. That it is hereby found and determined that all formal actions of Council concerning and relating to the passage of this Ordinance were adopted in an open meeting of Council and that all deliberations of Council and any of its committees that result in such formal action were in meetings open to the public in compliance with all legal requirements, including Section 121.22, Ohio Revised Code.
SECTION 7. That this Ordinance is hereby declared to be an emergency measure and shall take effect and be in force immediately from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective to facilitate the continuous use this property by the Center for active adult daily activities.
