Authorizing the expenditure of an amount not to exceed $53,100 from the Street Construction Maintenance and Repair Fund for the purchase of a three-year software maintenance agreement for the Division of Traffic Management’s Centracs traffic signal software; authorizing the Mayor to enter into the necessary contracts for said purchase; waiving the competitive bidding requirements of TMC Chapter 187; and declaring an emergency.
Body
SUMMARY & BACKGROUND:
The Division of Traffic Management needs to renew the Centracs software maintenance agreement which is one of the city’s traffic signal software programs used to manage two hundred and fifty intersections within the City of Toledo. This Ordinance authorizes the expenditure of funds needed to purchase the agreement. The total amount to be expended for the purchase is $53,100 which is included in the division’s operating budget. The software is used for writing, maintaining timing, and monitoring for any faults for 250 of the City of Toledo signalized intersections. This software is sold by Path Master, which is the sole distributor of Econolite products in the State of Ohio. Centracs software is produced by Econolite.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the expenditure of an amount not to exceed $53,100 is authorized from the Street Construction Maintenance and Repair Fund Account Code 2014-22500-2413002STDSTD for the purchase of a three-year Centracs Software Maintenance agreement.
SECTION 2. That the Mayor is authorized to enter into a contract with Path Master Inc. for the purchase of said software maintenance agreement, upon terms and conditions acceptable to the Directors of Law and the Department of Transportation.
SECTION 3. That this Council finds and determines it is in the best interest of the City to waive the competitive procurement requirements of Toledo Municipal Code Chapter 187 for this purchase for the reason that this software has been in use by the city since 2017 and is provided only by Path Master in the state of Ohio.
SECTION 4. That the Finance Director is authorized to draw their warrant or warrants against the above account code in an amount not to exceed $53,100 in payment of the above-authorized obligation and upon presentation of properly approved voucher or vouchers.
SECTION 5. That this Ordinance, being an emergency measure, shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that it is necessary for the immediate preservation of the public peace, health, safety, and property, and for the further reason that the Ordinance must be immediately effective in order to purchase Centracs software maintenance agreement in the furtherance of the Division of Traffic Management duties to be able to insure the proper operation of the Centracs software for the 250 of the city’s intersections.
