SUMMARY & BACKGROUND:
The U.S. Department of Justice, Federal Bureau of Investigation has funds available to law enforcement agencies for the purpose of joint task force operations. The Toledo Police Department will utilize the Ohio Building space for FBI joint task force operations. The value of the funding available to the Toledo Police Department is $162,000 which will be used to reimburse the general fund for the cost of this lease. The funds will cover the entire amount of the lease agreement with the Ohio Building Company LLC for a three year period. The reason for waiving competitive bidding lies in the fact that the FBI offices are currently located in the Ohio Building. This lease is for the term of one (1) year with the option of two (2) one-year renewals, commencing on the 1st day of October, 2024 and terminating on the 30th day of September, 2025 with the possibility of renewals extending it to 30th day of September, 2027. There are no matching requirements.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into a one-year lease agreement with the option for 2 additional one-year renewals with the Ohio Building Company, LLC for FBI joint task force operations upon terms and conditions acceptable to the Director of Law and the Director of Public Safety.
SECTION 2. That the Mayor is authorized to accept and deposit proceeds from the U.S. Department of Justice, Federal Bureau of Investigation in the amount of $162,000 into the General Fund Account Code 1001-52000-3381002STDSTD.
SECTION 3. That the annual expenditure of $54,000, subject to appropriations in future years, is authorized from the General Fund Account Code 1001-52000-3381002STDSTD for the purpose authorized in Section 1.
SECTION 4. That this Council finds and determines it is in the best interest of the city that the competitive procurement requirements of TMC Chapter 187 are waived for the reason that the unique office space is necessary for the co-location of participating law enforcement agencies and the operation of the joint task force.
SECTION 5. That the Finance Director is authorized to draw warrant or warrants against the above-mentioned Account Code in an amount not to exceed $54,000 annually in payment of the above authorized obligations upon presentation of the proper voucher or vouchers.
SECTION 6. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that it is necessary for the immediate preservation of the public peace, health, safety, and property, and for the further reason that this Ordinance must be immediately effective for uninterrupted operation of the joint task force.
