Authorizing the appropriation and expenditure of an amount not to exceed $50,000 from the unappropriated balance of the Capital Improvement Fund for the installation of snow plow storage racks; authorizing the waiving of competitive procurement provisions of TMC Chapter 187; and declaring an emergency.

SUMMARY & BACKGROUND:
The Division of Road & Bridge Maintenance (R&BM) received bids for the manufacturing of heavy-duty snow plow racks and pallets. Industrial Power Systems, Inc. (IPS) was the only bidder to submit a proposal in the amount of $363,610.49. IPS also submitted a proposal of $85,899.51 for the installation of the rack system. Ordinance 551-22 was approved on October 25th for the expenditure of $400,000 for this system. This ordinance is requesting approval to appropriate and expend no more than $50,000 to supplement the contract with IPS to pay for the entire installation of the rack system.
These racks and pallets will be used to safely store all of the snow plows that the division has for its trucks. This will keep the snow plows in the off season safe from damage and also make it safer for the employees to install the snow plows on the trucks.
The bids for the storage system were for three (3) buildings. The R&BM Central Ave. facility will have a storage system to manage up forty-two (42) plows while the Byrne Rd. facility and Water St. facility location will both manage up to twenty (20) plows each.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That an amount not to exceed $50,000 is authorized for appropriation from the unappropriated balance of the Capital Improvement Program Fund to Account Code 5040-23100-8CP2226PLWRCK for the installation of snow plow racks for the Toledo Department of Transportation Division of Road & Bridge Maintenance, and further authorizing the expenditure of same.
SECTION 2. That this Council finds and determines that the competitive procurement provisions of the TMC Chapter 187 are waived for the installation component of the plow rack system for the reason that Industrial Power Systems is the rack systems manufacturer and was the only bidder for the manufacturing of the snow plow storage system and the installation cost is found to be necessary and reasonable.
SECTION 3. That the Director of Finance is authorized to issue their warrant or warrants against the above-listed account code in an amount not to exceed $50,000 in payment of the obligations incurred pursuant to the contract authorized upon presentation of proper voucher or vouchers.
SECTION 4. That the disappropriation of any remaining budget to fund balance is authorized at closeout.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective in order to store and retrieve snow plows in a manner that is safest for employees.
