SUMMARY & BACKGROUND:

The Toledo Municipal Court has been awarded a grant of $1,533,400, a renewal and combination of the previous Justice Reinvestment and Incentive Grant (J.R.I.G) and the 408 Standard Probation program, from the State of Ohio, Department of Rehabilitation and Correction for the continuation of community-based non-residential programs and to improve probation services and to enhance access to treatment and educational programing for offenders in Toledo, Ohio, in 2023-2025. 

 

This grant provides funding for the continuation of intensive supervision, remote reporting and electronic monitoring programs, pays for most of the employment expenses of two (2) Probation Officers, assessments, substance abuse treatment, necessary services and supplies for this program and provides 100% funding for 1.5 FTE support staff positions, allows moderate and high-risk offenders to receive community-based substance abuse assessments, outpatient and residential substance abuse treatment, domestic violence counseling and employment counseling through June 30, 2025.

 

The grant provides a means to alleviate some need for jail confinement and at the same time, provides intensive probation supervision of defendants, who might otherwise be sentenced to CCNO for six months.  Defendants approved for the Standard Probation Program are released early from CCNO and receive assessment, drug testing, substance abuse treatment, and other types of mandatory services including in-person weekly contact for high risk offenders.  It is anticipated the program will serve 800 offenders by June 30, 2025.

 

The Remote Reporting Program uses grant dollars for low level offender supervision.  It is anticipated to monitor and supervise approximately 350 low risk offenders.

 

Grant funds also provide electronic monitoring (EM) services. It is anticipated the program will provide EM services for approximately 300 indigent sentenced Toledo Municipal Court defendants.

 

Summary

Now therefore, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.  That the Mayor is authorized to accept and deposit grant funds for the purpose of intensive supervision and remote reporting services for TMC sentenced defendants, electronic monitoring services for TMC indigent sentenced offenders and for assessments, treatment and counseling and to execute any required grant documents to reflect the grant award. 

 

                     SECTION 2.  That the Mayor, the Municipal Court Judges and the Municipal Court Administrator are authorized to enter into necessary contracts and agreements, under those terms acceptable to the Director of Law, to fulfill the purposes of the grant described herein.

 

             SECTION 3. That the sum of $1,533,400 is accepted pursuant to this Ordinance shall be deposited into Account Code 2016-10800-3G19741STDSTD and appropriated for expenditure for all proper purposes set forth herein. 

 

                     SECTION 4.  That the expenditure of funds from Account Code 2016-10800-3G19741STDSTD authorized for all proper purposes described in Section 1 shall not exceed $1,533,400.

 

SECTION 5.  That the Finance Director draw his or her warrant or warrants against the above referenced account code in payment of the above obligations upon presentation of proper voucher or vouchers and subject to the receipt of sufficient grant funding and continued availability. 

 

                     SECTION 6.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that the Ordinance must be immediately effective in order to accept the grant funds and continue the intensive supervision, kiosk and electronic monitoring programs.
