Title

SUMMARY & BACKGROUND:
The City of Toledo has been awarded funding and is invited to enter into a grant agreement with the Great Lakes Commission through the Active Adaptive Management Program (AAMP) for the purpose of controlling invasive phragmites on two city properties: Detwiler Marsh and Pontiac Preserve.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into and execute necessary agreements with the Great Lakes Commission (GLC) for purposes of the AAMP phragmites control project upon terms and conditions acceptable to the Director of Public Utilities and the Director of Law.
SECTION 2. That the Mayor is authorized to accept and deposit grant proceeds in the amount of $26,000 from the Great Lakes Restoration Initiative Operation Grants, Account Code 2016-38000-6G00314STDSTD, for the purpose of completing work necessary to administer the grant.
SECTION 3. That the appropriation of the amount not to exceed $26,000 is authorized from the unappropriated grant proceeds in an amount not to exceed $26,000 is authorized from the Operation Grants Fund into Account Code 2016-38000-6G00314STDSTD, and further authorizing the expenditure of same for the AAMP phragmites control project.
SECTION 4. That this City Council finds and determines it is in the best interest of the City to waive the competitive procurement requirements of TMC Chapter 187 for the reason that it is in the best interest of the City of Toledo to contract with New Roots Environmental for the amount not to exceed $25,000 as this entity is an expert in the field with an excellent record of performance.
SECTION 5. That the Director of Finance is authorized to issue their warrant or warrants against the Account Code listed in Section 3 in the amounts not to exceed those authorized above for the AAMP phragmites control project upon the presentation of the proper voucher or vouchers.
SECTION 6. That the disappropriation of any remaining budget to fund balance is authorized at project closeout.
SECTION 7. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to implement this project with the Great Lakes Commission’s designated time schedule.
