SUMMARY & BACKGROUND:
ProMedica Toledo Hospital is the developer of a property on the north side of Central Avenue and Doris Avenue. The developer has submitted a Traffic Impact Study, which proposes the installation of a traffic signal. Traffic signal warrant studies were conducted in accordance with the guidelines set forth by the Ohio Manual of Uniform Traffic Control Devices, which indicated that the development will generate sufficient traffic to meet the requirements for signalization at the aforementioned location and that this traffic signal is necessary to support site-generated traffic. As a result, the Division of Transportation has approved the installation of the traffic signal in question, subject to terms and conditions, including the condition that the developer be responsible for all costs associated with the installation and/or upgrade of this traffic signal. This legislation provides for the Agreement and accepts and appropriates the funds necessary for City personnel to perform certain tasks relating to the installation of this traffic signal.
Summary
NOW THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into an Agreement with ProMedica Toledo Hospital, whereby ProMedica Toledo Hospital will pay all costs for the design, construction, and installation of a traffic signal at the intersection of Central Avenue and Doris Avenue/ProMedica North Campus Driveway.
SECTION 2. That the Mayor is authorized to accept and deposit $8,000 in funds from ProMedica Toledo Hospital, into Account Code 5040-22500-8DAPMCENDORTS in accordance with the Agreement authorized above in Section 1.
SECTION 3. That an expenditure in an amount not to exceed $8,000 is authorized from the Capital Improvement Fund, Account Code 5040-22500-8DAMCENDORTS, for the payment of labor and material costs to be incurred by the City for the installation of a traffic signal; and further authorizing the expenditure of same.
SECTION 4. That any excess funds from this installation shall be returned to the developer.
SECTION 5. That the Finance Director is authorized to draw warrant or warrants against the above mentioned Account Code in an amount not to exceed $8,000 in payment of the obligation herein above authorized upon presentation of the proper voucher or vouchers.
SECTION 6. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety, and property, and for the further reason of proceeding in cooperation with ProMedica Toledo Hospital on the timely installation of the traffic signalization.
