Authorizing the mayor to enter into an agreement with and accept a grant from the State of Ohio, Department of Transportation (ODOT) in an amount not to exceed $2,000,000; authorizing the mayor to enter into an agreement with and accept a grant from the Ohio Public Works Commission (OPWC) in an amount not to exceed $656,744; authorizing the deposit, appropriation and expenditure of said amounts for the construction of Secor Road Bridge over the Ottawa River; authorizing the mayor to execute all necessary documentation for said grants and to execute the necessary contracts related to construction, professional services, contingencies, testing, and permit fees; and declaring an emergency.

SUMMARY & BACKGROUND:
The Division of Road & Bridge Maintenance has successfully applied and received funding assistance for the construction of Secor Road Bridge over the Ottawa River. This funding assistance is in the form of a grant from ODOT Municipal Bridge funds as well as a grant from OPWC. Resolution 460-20 authorized an agreement with the Village of Ottawa Hills and application to OPWC. Construction cost is Grant funds of $2,000,000 from ODOT and $656,744 from OPWC will pay for the majority of construction costs. The remaining cost will be shared equally between the Village of Ottawa Hills and the City of Toledo. Sufficient match funds for the City of Toledo portion are provided in the 2022 Bridges Matches and Planning budget.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the mayor is authorized to enter into an agreement with ODOT to accept and deposit an amount not to exceed $2,000,000 for the construction of Secor Road Bridge over Ottawa River.
SECTION 2. That an amount not to exceed $2,000,000 is appropriated from the unappropriated grant proceeds in the Capital Improvement Grant Fund to Account Code 540G-23100-8GA7761STDSTD; and that these amounts are authorized for expenditure for the purposes set forth herein.
SECTION 3. That the mayor is authorized to enter into an agreement with OPWC to accept and deposit an amount not to exceed $656,744 for the construction of Secor Road Bridge over Ottawa River.
SECTION 4. That an amount not to exceed $656,744 is appropriated from the unappropriated grant proceeds in the Capital Improvement Grant Fund to Account Code 540G-23100-8GA7503STDSTD; and that these amounts are authorized for the expenditure for the purposes set forth herein.
SECTION 5. That the mayor acknowledges the City’s continuing compliance with applicable state and federal directives that pertain to it regarding bridge ownership within the municipality pursuant to terms and conditions acceptable to the Director of Toledo Department of Transportation and Director of Law.
SECTION 6. That the mayor is authorized to prepare plans and specifications, accept bids and enter into contracts necessary to complete said projects including such items as labor, materials, construction testing, professional services, property appraisals, title work, negotiations, acquisition, and environmental contamination studies that are necessary to acquire additional rights-of-way. Said contracts shall contain such terms and conditions as the Director of Toledo Department of Transportation may deem requisite and proper and shall be subject to approval by the Director of Law.
SECTION 7. That the Director of Finance is authorized to issue their warrant or warrants against the above listed account codes in the amounts listed in payment of the obligations upon presentation of proper voucher or vouchers.
SECTION 8. That the disappropriation of any remaining budget to fund balance is authorized at project closeout.
SECTION 9. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective in order to meet deadlines for planning, design, environmental studies, bid and construction.
