SUMMARY & BACKGROUND:

Ordinance 478-23 previously authorized the acceptance of an Air Grant from the Ohio Environmental Protection Agency (OEPA) in the amount of $1,350,000 and a grant amount from the United States Environmental Protection Agency (USEPA) in the amount of $650,000 both of which were authorized to be deposited into the Operation Grant Fund. Subsequently, the OEPA increased their grant award by $81,624 and the USEPA decreased their grant award by $89,987. Therefore, this ordinance is to authorize the acceptance and deposit of the additional award received from the OEPA, no further required match is needed from the General Fund.

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That the Mayor is authorized to execute and enter into grant agreements with the United States Environmental Protection Agency and the Ohio Environmental Protection Agency, as necessary, on behalf of the City, upon terms acceptable to the Director of Public Utilities and the Director of Law.

 

SECTION 2.                       That the Mayor is authorized to accept and deposit grant proceeds into the Operation Grants Fund in an amount not to exceed an additional $81,624 into Account Code 2016-38000-6G2024SSTDSTD, for the purpose of completing work necessary to carry out the terms of the air grant agreements.

 

SECTION 3.                       That the amount of $81,624 is appropriated from the unappropriated grant proceeds in the Operation Grants Fund into Account Code 2016-38000-6G2024SSTDSTD for the purpose listed in Section 2; and further authorizing the expenditure of same per the terms of the air grant agreements.

 

SECTION 4. That an amount not to exceed $72,805 is disappropriated to the unappropriated grant proceeds in the Operation Grants Fund from Account Code 2016-38000-6G2024VSTDSTD and an amount not to exceed $17,182 is disappropriated to the unappropriated grant proceeds in the Operation Grants Fund from Account Code 2016-38000-6G2024PSTDSTD.

 

SECTION 5.                     That the Mayor is authorized to accept bids and award contracts for the purchase of supplies, equipment vehicles, and other necessary items to carry out the terms of these grants upon such terms and conditions as shall be approved by the Director of Public Utilities and the Director of Law. 

 

SECTION 6.                     That the Director of Finance is authorized to issue their warrant or warrants against the Account Code listed in Section 3 in an amount not to exceed $81,624 in payment of the above authorized obligations upon presentation of the proper voucher or vouchers.

 

                     SECTION 7.                       That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the environment in the Toledo metropolitan area and for the further reason that the Ordinance must be immediately effective in order to satisfy the grant requirements.
