SUMMARY & BACKGROUND:
An application (Z-8001-24) for a proposed change in zoning for the property located at 3815 W. Sylvania Avenue, in Toledo, Ohio, was submitted to the Toledo City Plan Commission for its review and recommendation.
On October 10, 2024, the Toledo City Plan Commission recommended approval of the request for a zone change from “RM36” Multi-Family Residential and “RS9” Single-Dwelling Residential to “CO” Office Commercial for the property located at 3815 W. Sylvania Avenue, in Toledo, Ohio.
On November 12, 2024, the Toledo City Council Zoning and Planning Committee left in committee due to the lack of a quorum, the request for a zone change from “RM36” Multi-Family Residential and “RS9” Single-Dwelling Residential to “CO” Office Commercial for the property located at 3815 W. Sylvania Avenue, in Toledo, Ohio.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the zoning maps attached to Part 11, Planning and Zoning, Toledo Municipal Code, are hereby authorized to be revised by changing the zoning district of that part of the City of Toledo more fully described as follows:
The Westerly 300 feet of that part of the Northwest fractional ¼ of Section 19, Town 9 South, Range 7 East, in the city of Toledo, Lucas County, Ohio bounded and described as follows:
Beginning at a point on the East line of the Northwest ¼ of said Section 19, that is 2,213.565 feet Northerly of the Southeast corner of the Northwest ¼ of said Section 19;
Thence Westerly, a distance of 801.57 feet to a point that is 2,201.64 feet Northerly o the South line of the Northwest ¼ of said Section 19;
Thence Northerly, a distance of 340 feet to a point on the North line of the Northwest ¼ of said Section 19 that is 801.53 feet Westerly of the Northeast corner of the Northwest ¼ of said Section 19;
Thence Easterly along the North line of the Northwest ¼ of said Section 19, a distance of 801.53 feet to the Northeast corner of the Northwest of said Section 19
Thence Southerly along the East line of the Northwest ¼ of said Section19, a distance of 340 feet to the point of the beginning.
Subject to legal highways.
Excepting therefrom that part thereof appropriated by the City of Toledo for the widening of Sylvania Avenue by proceedings in Cause No. 05456, Common Pleas Court, Lucas County, Ohio.
SECTION 2. The Secretary of the Toledo City Plan Commission is hereby authorized and directed to make the said change on the original zoning maps.
SECTION 3. That this Ordinance hereby is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that the Ordinance must be immediately effective in order to provide for the orderly regulation and use of the property and to protect the land value in the area.
