SUMMARY & BACKGROUND:

Ordinance 143-26 previously authorized the acceptance of a Source Water Protective Strategies Grant from the Ohio Environmental Protection Agency (OEPA) in the amount of $15,129 which was authorized to be deposited into the Water Replacement Fund. Subsequently, the OEPA increased their grant award by $4,841.  Therefore, this ordinance is to authorize the acceptance and deposit of the additional award received from the OEPA.

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That the Mayor is authorized to execute and enter into grant agreements with the Ohio Environmental Protection Agency for the Source Water Protective Strategies Grant upon terms acceptable to the Director of Public Utilities and the Director of Law.

 

SECTION 2.                       That the Mayor is authorized to accept and deposit grant proceeds into the Water Replacement Fund in an amount not to exceed an additional $4,841 into Account Code 663G-32000-4UG1526STDSTD, for the purpose of completing work necessary to administer the grant.

 

SECTION 3.                       That the amount of $4,841 is appropriated from the unappropriated grant proceeds in the Water Replacement Fund into Account Code 663G-32000-4UG1526STDSTD for the purpose listed in Section 2; and further authorizing the expenditure of same per the terms of the grant agreement.

 

SECTION 4.                     That the Mayor is authorized to enter into an amended agreement with The Ohio State University for the purpose of the grant, upon terms and conditions acceptable to the Director of Public Utilities and the Director of Law. 

 

SECTION 5.  That this Council finds and determines it is in the best interest of the City to waive competitive bidding requirements of the TMC Chapter 187 for the reason that The Ohio State University is uniquely qualified through their extension agents to complete the education and outreach efforts.

 

SECTION 6.                     That the Director of Finance is authorized to issue their warrant or warrants against the Account Code above in amounts not to exceed those above in payment of the above-authorized obligations upon presentation of proper voucher or vouchers.

 

                     SECTION 7.                       That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the environment in the Toledo metropolitan area and for the further reason that the Ordinance must be immediately effective in order to satisfy the grant requirements.
