Title

Authorizing the Mayor to enter into agreements with Toledo Lucas County Health Department and others for necessary marketing, communications, training development and other Lead Ordinance duties related to Toledo Municipal Code Chapter 1760 and Lead Safety Compliance; authorizing the expenditure of an amount not to exceed $105,492 from the General Fund; waive competitive bidding provisions of TMC Ch. 187; and declaring an emergency.

SUMMARY & BACKGROUND:

The purpose of this ordinance is to expend available funding to Toledo Lucas County Health Department and others for the purpose of marketing, training development, communications and other Lead Ordinance duties; and waive competitive bidding requirements that will support the Lead Safe Ordinance (397.20).

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That the expenditure of an amount not to exceed $105,492 is authorized from General Fund Account Code 1001-16200-5632005STDSTD for necessary Lead Ordinance marketing, communications, training development, and related activities. 

 

                     SECTION 2. That the Mayor is authorized to enter into agreements with Toledo Lucas County Health Department and others for marketing, communications, training development and other Lead Ordinance duties related to Toledo Municipal Code Chapter 1760. 

 

                     SECTION 3. That the Finance Director is authorized to draw their warrant or warrants against the above Account Code in an amount not to exceed $105,492.00 in payment of the above-authorized obligations upon presentation of the proper voucher or vouchers.

 

                     SECTION 4. That this Council finds and determines it is in the best interest of the city to waive the competitive procurement requirements of TMC Chapter 187 for the reason that the Toledo Lucas County Health Department is a political subdivision of the State of Ohio and is  uniquely familiar with the subject ordinance.

 

                     SECTION 5. That this Ordinance, being an emergency measure, shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective to timely expend these funds for lead-related activities.
