SUMMARY & BACKGROUND:

An application (Z-4009-24) for a proposed change in zoning for the property located at 0 N. Michigan (Parcels 14-30143, 14-30142, 14-30145), 1934-1945 Champlain St, 914-926 Rex St. & proposed vacated alley, Toledo, Ohio, was submitted to the Toledo City Plan Commission for its review and recommendation.

 

On June 13, 2024, the Toledo City Plan Commission recommended approval of the request for a zone change from “RS6” Single Family Residential and “IL” limited Industrial to “IL” limited Industrial for the property located at 0 N. Michigan (Parcels 14-30143, 14-30142, 14-30145), 1934-1945 Champlain St, 914-926 Rex St. & proposed vacated alley, Toledo, Ohio.

 

On July 16, 2024, the Toledo City Council recommended approval the request for a zone change from “RS6” Single Family Residential and “IL” limited Industrial to “IL” limited Industrial for the property located at 0 N. Michigan (Parcels 14-30143, 14-30142, 14-30145), 1934-1945 Champlain St, 914-926 Rex St. & proposed vacated alley, Toledo, Ohio.

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.  That the zoning maps attached to Part 11, Planning and Zoning, Toledo Municipal Code, are hereby authorized to be revised by changing the zone districts of that part of the City of Toledo more fully described as follows:

 

A parcel of land being part of the lot 289, 290 & lot 291 of the Stickney's 3rd Addition (Plat Vol 2A Page 2), Part of Stickney's Addition of Lot 290 (Plat Vol 16 Page 14) and Part of Tracy's Subdivision of Lot 291 (Plat Vol 13 Page 29) in Section 30, Town 9 South, Range 8 East, City of Toledo, Lucas County, Ohio, and more particularly described as follows:

 

Commencing at an Iron Pin (1" Found) monument marking the Intersection of Galena Street (As in Now Exists) and Michigan Street (66' Right-of-way);

 

Thence South 43°51'56" West along the Centerline of said Michigan Street, a distance of 629.88 Feet to a PK Nail (set);

 

Thence North 45°58'04" West, a distance of 33.00 Feet to an Iron Pipe (1/2" Found), said point being on the northerly right-of-way line of said Michigan Street, being the southwest corner of Lot 11 in said Stickney's Addition of Lot 290, also being the southwest corner of Parcel 'D' now or formerly owned by Henry Gurtzweiler, Inc. (OR 00-0179 B04), said point also being the Point of Beginning of the herein described Rezoning Exhibit;

 

Thence North 45°58'04" West, along the southerly line of said Lot 11, a distance of 112.00 Feet to a Point, said point being the northwest corner of said Lot 11, ;

 

Thence South 43°51'56" West, along the northerly line of Lot 1 & Lot 2 in said Stickney's Addition of Lot 290, a distance of 49.50 feet to a Point, said point being the northwest corner of said Lot 1, said point also being on the easterly line of Lot 23 in said Tracy's Subdivision of Stickney;

 

Thence South 45°58'04" East, along the easterly line of said Lot 23, a distance of 9.00 feet to an Iron Pipe (Bent), said point being the northeast corner of said Lot 23;

 

Thence South 43°51'56" West, along the southerly line of said Lot 23, a distance of 89.69 feet to a point, said point being the southwest corner of said Lot 23, said point also being on the northerly right-of-way line of Rex Street (48' wide Right-of-way);

 

Thence North 45°58'04" West, along the northerly right-of-way line of said Rex Street and southerly line of Lot 19 thru Lot 23 of said Tracy's Subdivision of Lot 291, a distance of 150.00 feet to a point, said point being the northwest corner of said Lot 19, said point also being on the southerly right-of-way line of Champlain Street (30' wide Right-of-way);

 

Thence North 43°51'56" East, along the northerly line of said Lot 19 and the southerly right-of-way line of said Champlain Street, a distance of 89.69 feet to a point, said point being the northeast corner of said Lot 19;

 

Thence North 45°58'04" West, along the easterly line of Lot 17 & Lot 18 in said Tracy's Subdivision of Stickney, a distance of 44.50 feet to a Point;

 

Thence North 43°51'56" East, along the southerly line of Lot 5 thru Lot 8 in said Stickney's Addition of Lot 290, a distance of 99.00 feet to a Point, said point being the southeast corner of said Lot 8;

 

Thence North 32°19'01" East, a distance of 27.56 feet to a Point, said point being a Westerly corner of 0.198 acre parcel known as Parcel 'G' now or formerly owned by Henry Gurtzweiler, Inc. (OR 00-0179 B04):

 

Thence crossing said Lot 289 & Lot 290 with the following ten (10) courses, said courses being along Parcel 'G' & Parcel 'H' now or formerly owned by Henry Gurtzweiler, Inc. (OR 00-0179 B04):

   (J)  South 43°51'56" West, a distance of 7.20 feet to a Point, said point being the northeast corner of Parcel 'E' now or formerly owned by Henry Gurtzweiler, Inc. (OR 00-0179 B04):

 

Thence South 19°26'10" East, along the northerly line of said Parcel 'E', a distance of 44.77 feet to a Point;

 

Thence South 45°58'04" East, along the northerly line of said Parcel 'E', a distance of 72.00 feet to a Point, said point on the northerly right-of-way line of Michigan Street (66' wide Right-of-way);

 

Thence South 43°51'56" West, along said northerly right-of-way line of Michigan Street, a distance of 193.00 feet to an Iron Pipe (1/2" Found), said point being the Point of Beginning of herein described Rezoning Exhibit, containing 2.2834-Acres (99,465.66 SF) more or less, subject to legal highways, easements and restrictions of record.

 

Basis of Bearings for the herein description being the centerline of Relocated Champlain Street, being as North 48°24'33" East per LUC-280-4.25 ODOT Roadway Plans. Based upon an assumed meridian and should be used only for the purposes of describing horizontal angular measurements.

SECTION 2.  The Secretary of the Toledo City Plan Commission is hereby authorized and directed to make the said change on the original zoning maps.

 

SECTION 3.  That this Ordinance hereby is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that the Ordinance must be immediately effective in order to provide for the orderly regulation and use of the property and to protect the land value in the area.

 

Vote on emergency clause:  yeas 11, nays 0.
