Body

SUMMARY & BACKGROUND:

The City of Toledo is entering into a contractual agreement to use SWPPPTrackPro software and servers for its environmental compliance and enforcement activities as required by the City’s NPDES permit. The use of this software will allow for more timely notifications of violations to property owners and/or construction responsible parties, automate documentation of correspondence of said violations and resolutions, and save staff time by working with a comprehensive software package specifically designed to handle these types of tasks. The first year of the three-year contract is in the amount of $26,479, including a one-time set up fee of $4,999.

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

SECTION 1. That the Mayor is authorized to enter into a three-year software license agreement with two three-year renewal options with Storm Water Simplified, Ltd for the purchase of SWPPPTrackPro, upon terms and conditions acceptable to the Director of Public Utilities and the Director of Law.

SECTION 2. That subject to future appropriations the expenditure of an amount not to exceed $27,000 annually is authorized for the contract authorized in Section 1 from the Storm Water Operating Fund, Account code 607A-38000-4000552STDSTD.

SECTION 3. That this Council finds and determines it is in the best interest of the City to waive the competitive bidding provision of TMC Chapter 187 for the use of SWPPPTrackPro software package for management and documentation of environmental compliance and enforcement activities as Storm Water Simplified, Ltd, is the sole source provider of this software package, which is required by ODOT for its contractors and is used nationally for storm water compliance and enforcement management.

SECTION 4. That the Director of Finance is authorized to issue their warrant or warrants against the Account Code listed in Section 2 in the amounts not to exceed those authorized above upon the presentation of the proper voucher or vouchers.

SECTION 5. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage.  The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to maintain critical elements in the City’s storm water system.
