SUMMARY & BACKGROUND:
Ordinance 92-13 authorized the City to enter into a Dockmaster Services Agreement for the operation of the Toledo Skyway Marina with Toledo Skyway Marina, LLC. That Agreement expires on May 17, 2022 and the operator is not interested in renewing.
The City desires to enter into a Dockmaster Services Agreement for the operation of the Toledo Skyway Marina with the Metropolitan Park District of the Toledo Area.

Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into a 2-year Dockmaster Services Agreement with the Metropolitan Park District of the Toledo Area for the operation of the Toledo Skyway Marina upon such terms and conditions as are approved by the Director of Law and the Director of Public Service.
SECTION 2. That revenue received under the Dockmaster Services Agreement is authorized to be deposited in the Marina Development Fund Account Code 2007-60300-772X002STDSTD.
SECTION 3. That this Council finds and determines it is in the best interest of the City to waive the competitive bid requirements under Toledo Municipal Code Chapter 187 for the reason that the Metropolitan Park District of the Toledo Area is uniquely situated to manage the docks at the Toledo Skyway Marina, which is adjacent to and compatible with the Glass City Metropark.
SECTION 4. It is found and determined that all formal actions of City Council concerning and relating the passage of this ordinance were taken in open meeting of City Council, that all deliberations of City Council and any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements, including those of Section 121.11 of the Ohio Revised Code.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall take effect and be in force immediately from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason to have a Dockmaster Services Agreement in advance of the 2022 boating season and it is the City of Toledo’s best interest to have the Toledo Skyway Marina operating immediately.
