Title

Requesting the Toledo City Plan Commission conduct a study regarding the effects of  Scrap and Salvage Yards in the City of Toledo; and declaring an emergency.

SUMMARY & BACKGROUND:

Scrap and Salvage Yards pose potential site development issues, site maintenance, and nuisance concerns for nearby residents. Toledo City Council is asking for a study by the Toledo City Plan Commission to research the secondary effects of Scrap and Salvage Yards on residents and neighborhoods in Toledo and to propose any possible code changes in the Toledo Municipal Code.

 

The requested study shall allow for the Toledo City Plan Commission to hold hearings, meetings, and other appropriate and necessary actions regarding the examination of secondary health issues, air pollution and metallurgical dust issues, noise, sweeping of debris on the public right of way, piling of materials, and maintaining proper fencing

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

SECTION 1. The Toledo City Plan Commission is directed to conduct the requested Study and provide its findings and recommendations to council in a timely manner.

 

              SECTION 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this Ordinance were passed in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. 

 

              SECTION 3. That this Ordinance, being an emergency measure, shall take effect and be in force from and after its passage.  The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health and safety, and for the further reason that a moratorium is necessary to allow additional time to study the report and recommendations of the Plan Commission and the public health and safety impact of Scrap and Salvage Yards in the City of Toledo.

 

Vote on emergency clause:  yeas 11, nays 0.
