SUMMARY & BACKGROUND:
This ordinance authorizes the Mayor to enter into an agreement with Axon Enterprises Inc. for a 27-month agreement to run concurrent with the remaining five-year agreement for the Taser 7 Conducted Energy Weapon (CEW) (ord.83-19). This additional agreement is for the Axon Virtual Reality Training Simulator. Axon's Virtual Reality Simulator will provide immersive virtual reality content that can help officers develop critical thinking, de-escalation and tactical skills. The simulator enables officers to work through complex scenarios that have been refined and validated by a diverse network of first responders and subject matter experts. It allows officers to actually talk and walk through the scenario as they would in the field, with feedback from trainers and supervisors, allowing them to practice more and enhance their skills, better preparing them for the situations they encounter each day. Axon is the sole source manufacturer of Taser products.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into an agreement with Axon Enterprises Inc. for a 27-month period for the Axon Taser Virtual Reality Simulator upon terms and conditions acceptable to the Director of Police and the Director of Law.
SECTION 2. That the amount not to exceed $78,000 is authorized for expenditure from the Law Enforcement Trust Fund Account Code 2090-52000-3T32302STDSLC for the first 15 months of this agreement. That the amount not to exceed $59,000 is authorized for expenditure from the General Fund Account Code 1001-52000-3381002STDSTD for the remaining 12 months of this agreement; subject to future appropriations.
SECTION 3. That this Council finds and determines it is in the best interest of the city to waive the competitive bidding requirements of TMC Chapter 187 for the reason that Axon Enterprises Inc. remains the sole-source provider for the Taser 7 and the compatible Axon Taser Virtual Reality Simulator.
SECTION 4. That the Finance Director is authorized to draw a warrant or warrants against the above referenced Account Codes in payment of the obligation authorized in Section 1 herein in an amount not to exceed that authorized above and upon presentation of proper voucher or vouchers.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that it is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that the ordinance must be immediately effective in order to enter into the agreement with Axon Enterprises Inc.to maintain public safety.
